I have been scammed by Ameri Home mortgage. On October 19 I closed my loan at receiving 4200.00 cash back. I called them on the 24th for my check and they said it was not in. (I had a 3 day recession period to change my mind about the loan) On the 25th I was called to pick up my check. The check amout was 3070.00!

I was told by the lender that the loan was close and the funds issued were final. Ameri Home mortgage gave me their apologies (a sad story about the appraisal back 2000.00 less than expected and the title company providing wrong figures) By the way my cousin in the president of Ameri Home mortgage and his wife Caula Butler co-owner. She was the one who close my loan. She is a notary her self but there was no attorney present nor title company present at closing.

Her secretary was called in for a minute to sign something as a witness and she then returned to the back room where she works. Here is the catch. I have 2 hud settlements. One signed by me on the 19th at the closing. One signed by me on the 25th...(dated the 19th also). She told me that I had to sign on the 25th to receive my check. I had no idea that she would trash the original and replace it with the new one. (I have copies of both)The bottom line is I planned my wedding around the 4200.00.

I skipped bills and used the money for other things since I thought I had closed the loan and knew exactly how much money I had to work with. I planned my debts down to the last penny. Mrs. Butler charged my 1200.00 to do my loan.

I asked her to cut her loses and give me the money since it was her fault that I did not receive what I agreed to. Well to make a long story short...we got in to an argument which result into a fight. I now have a simple battery charge against me and have to go to court. She also told the officer that she wanted me to go to jail and he refused...he didn't believe her acusations. If things did get messed up with my loan I dont feel that I should have to be the one to suffer the loses...I only agreed to 4200.00 I was forced to take 3070.00.

I have talked to the office of financial institution and after speaking with her they told me that its my word against hers ( but the lender which is American Fidelty) must have some knowledge of the change. I also contacted the Better Business Bureau and after speaking to her they told me that she has an attorney so they cannot get involved.

If she does have an attorney its for the simple battery charge not me getting justice (my money). I have no got an attorney yet ( I cannot afford one at this time) But ever one that I talk to backs out once they speak to her. I DID NOT AGREE TO 3070.00. I WAS BASICALLY TOLD TAKE THE 3070.00 OR LEAVE IT AND STILL PAY FOR IT. I WAS IN NO SITUATION TO LEAVE IT AND STILL HAVE TO PAY FOR IT.

My name is Caula Butler and I have been a loan officer for 15 years and have never encountered anything of this nature before. I am the individual that has been named in the RipOff Report dealing with Ameri-Home Mortgage. Yes, I handled a loan for Ingrid Butler; yes, her closing took place at a title company; yes, the amount of her cash back changed; yes, she was aware before closing that the cash back amount had changed and still proceeded to close; yes, she had 3 days to decide she wanted to resend the loan and she did not; yes, she received her check , cashed her check, and spent all of the money;  yes, she and I got into a fight and I did press charges since she came into my business and attacked me (looking back I should have tried to handle the situation in a different manner even though I was the one attacked); no, Ingrid Butler did not act professionally and  the judge even asked Ingrid Butler why she came and attacked me when our company was not the responsible party for cutting the cash back checks (the title company was) and she could not provide an answer; yes, the police did not want to press charges since I had  gotten the best of her and they did not feel a report was necessary since she had gotten what she deserved eventually they did take the report since she did attack me;  yes, I  defended myself by giving her the beating of her life (wouldnt you?-I believe I acted in a manner that anyone else would have under the circumstances); and yes, OFI and BBB got involved even though Ingrid Butler said they did not and they found that I did nothing wrong. Ameri-Home Mortgage takes pride in providing service beyond expectations and I am being accused of a lot of things that are not true. I just found out about this RipOff Report and I am saddened that Ingrid Butler would go as far as to post inaccurate statements to the internet; however, I feel that the true story needs to be told. All the information within my rebuttal can be verified through several organizations as well as police and court reports.
