American Servicing Company Destroying Another Family. Fort Mills South Carolina

We have been in the process of trying to do a modification for our loan. My husband had lost his job and found another but for half the pay. I lost my job in Sept and have not found another one. We have a 3rd party helping us to do the modification. She has had many yrs of experience. We started in January. We had all of the proper paperwork. Sent all of the it in as instructed. They gave us a number to send everything in and would get back to us in a week. Nothing happened. They did not get back to us except thier collections deptartment. Our 3rd party called them and they said that they did not recieve it. Came to find out they had given us supposedly the wrong number. So she resent everything. Waited to the next day, they said they had not received the fax. She sent in the packet again, was told that some of the SS#'s were not on all of the paperwork. They were. So she resent it in again. After a few weeks of going back and forth sending and resending (5 times) we were told they would immediatly take our home off of the forclosure list.

we were told that as soon as I signed some papers and sent them in everything would be ok. Well, it's not. The only thing we received in the mail was a coupon stating that we pay a total of $6,000 up front. They would take our name off of the forclosure list and our mortgage rate would be an additional $300.00 more than it was before. If we do not send in this money, then forclosure would go on as before. Our family is scared, frustrated and angry. Is there another avenue that our family can take to hold off these people? All we have had is lies. The coupon was $4000.00 more than what we initially were behind in. Lots of additional fees. Is this legal? Is this a ploy by all mortgage companies? Can anything be done to them to protect those who are really trying?
