I took my 2001 Honda S2000 with 10,000 mile on Saturday 8/22 for a new sets of tires.
While the car is at the shop, one of their employee backed a truck into my S2000. At first the employee told me he was backing up a corporate truck while talking to a customer through the window, and didn't see my car. Then he changed his story to it's his dad truck and he was off the clock. After I asked to see the manager, Alan Haight, to discuss about the shop's liability. Mr. Haight claim the employee is personally responsible for the damage, not the shop. "It's like parking your car at Target, and someone hit your car. Target is not responsible for the damage, so are we." I didn't want to waste any more time with them, so I asked for a written statement. Mr. Haight wrote: 2001 Honda S200 was left in our posession to insall new tire, the vehicle was hit in the Parking lot, by an Employee driving his own vehicle." I guess I will see you in court.

Well, I didn't mention anything about "off the clock" in my post and yet you mentioned it.
Really? So I guess that the following sentence just magically ended up in your original post....

Notice the words that I underlined. So do you still deny you mentioned anything about "off the clock"?
Now, beyond that it is all very simple. You obviously know the name of the employee, as well as the truck involved. You can find out who the truck is registered to. If it is the owner or company, you probably have a valid claim against the owner and company. If it is though as they say and the employee's(or his dad's) truck and he was off of the clock, then your claim is with the employee(or dad).
Do you really think the owner would just dip into their register and pull out a few bills to repair your truck? NO...they are going to let their insurance handle it. So in the end it doesn't matter if your truck is being repaired by the Owner's Insurance or the Employee's. Since the idea of insurance is to make you "whole" not for you to make a profit, why does it matter who pays for it?
And before you ask, NO I do not now or have I ever worked for this company.

So I guess you are not a 3rd party, but an employee of the shop?
The employer took possession of my car, had my key. An employee hit it while talking to a customer.
Quick buck of what? Asking emplyer to repair the damage is a quick buck?

Yet again the consumer looks for MORE then they deserve. Ok we get it. An employee hit your vehicle. Guess what, THE EMPLOYEE is the responsible party!! YOU are just looking for a quick buck in your pocket for something that WAS NOT directly thier fault. That would be like YOU hitting someone in your jobs parking lot AFTER you were off the clock. It wouldnt matter WHERE the vehicle is damaged, YOU would STILL be the responsible party. The same goes for YOUR situation!!! You go right ahead and WASTE that cash trying to put out yet ANOTHER frivilous lawsuit. Its a SHAME that as Americans WE get to SUE whomever we wish, even if we are NOT in the right. It really goes to show the self entitled nature of most American Citizens.
