Once again, Applied Bank (formerly known as Cross-Country Bank) has screwed me and there is nothing I can do about it.  And they continue to be allowed to do what they are doing.  I became behind in my payments, but have been paying what I can for the last several months.  My account is below the credit limit, but they still report to the credit bureau that I am over 60 days delinquent, even though I have paid them $50.00 per month for more than the last 3 months, they still want a minimum payment of $150.26 on a TOTAL balance of $268.46.  My credit limit is $300.00 and I have no intention of paying over 50% of my ENTIRE balance as a minimum payment and then making another payment in addition so that I am not "2 payments behind"?  Not going to happen and someone needs to shut down these loan sharks!

These people hound me at home and at work on the telephone, even though I have informed them that I am not allowed to accept personal calls at work and even after filing a complaint with the FTC that has been ignored.  They want to "discuss" this only over the telephone and will not accept online or written inquiries where there is proof of their illegal activities.

Avoid these rip-off artists!!!

Actually the guy in Orlando was being sarcastic..lol

He and Robert have been regulars on this site and their viewpoints are the same. He was just trying to make a point, but sarcasm doesn't come through well online unless you are familiar with their usual style or POV. I'm personally glad you jumped in to defend Robert. It's refreshing to see.

To the guy in Orlando...

Holy crap! Did you seriously say that having credit is a RIGHT? Umm hello, in the real world having credit is not a right it is a privilege. I guess you might not know that since your credit is most likely shot. I have had the best of credit and I have had the worst of credit and guess what, both were due to MY OWN actions. Yes, the economy was bad when I had bad credit but you chose your career path, you chose not to take the insurance that credit card companies offer in case you lose your job, and YOU are behind on your bills. I never thought I would side with a credit card company but you act as if you are OWED something from them. They owe you nothing! Also you state on here that they want a minimum payment of $150.26... I know from experience that the reason your minimum payment is so high is because you HAVE NOT been paying your minimum payment. They don't just give you a minimum payment that high so who are you trying to fool? I could go on and on about your ridiculous OPINIONS because they are definitely NOT facts... And to Robert.. I agree with you completely... You do not have to work for the bank or credit card company to see that this person is just insane...

Thanx.

Thanks Jimmy for enlightening me.  I thought the "Real World" was just a show on MTV.  You have encouraged me to go review my Constitutional history because I totally forgot that Credit was a right.

As for credit cards.  How dare any bank only give someone a $300 credit limit.  Heck you can't even buy a 40" TV on Black Friday with that little amount of money.

Congress needs to get on this to protect the little guy.  They need to create laws that make it illegal for creditors to assign credit limits.  I mean the person who is using the credit card must be responsible enough that they know when to stop spending money.  Then don't even get me started on paying it back.  I don't know why I was so blind.  If a person can only pay $50 because they decided to pick up the latest DVD to go with their new Blu-Ray player the bank just needs to understand and get off of their back.

I don't even know why a person would suggest to get another job.  I go down to my local mall and all I see are these fake "now hiring" signs.  Everyone knows that they are just there to fool people.

Once again Jimmy thank you for opening my eyes.

Oh Robert...You Are So Judgemental!

AUTHOR: Jim - (USA)

POSTED: Sunday, November 28, 2010

Robert Baby...you just don't understand finance!  You are also so, so, so judgemental.  Allow me to enlighten you, dear boy...

1.  Credit is a "right" and is "owed" to everybody!

2.  This bank, like all the others have received huge government bailouts but that's not enough!  Here they are going after the "little people".  Don't you know there's a big conspiracy between the banks to get rich off the backs of the "little people"?

3.  This bank has billions and billions.  It is totally unethical for them to demand minimum payments.  Somebody should start a class action suit.

4.  These big banks need to have more customer service people who understand how hard it is to make it in this economy!  They need to help people instead of demanding money.  But thats all they care about is money!

5.  Don't you even remotely suggest these people get an additional job to supplement their income!  They need to have enough hours to enjoy life, have a few drinks, smoke some cigarettes.  Its their right, you know.  Besides Robert, everybody knows there are no jobs.

6.  Apparently you are of the super rich.  You probably work for the bank.  You just don't understand, do you?  When these people are late with their payments, its not their fault the economy is bad.

7.  You just don't get it, Bobby boy!  You have zero compassion!  Its tough, damned tough for an unwed mother with five kids from five guys to make it today or for a guy who's paying child support to four different women to have extra money.  Stop being so damned judgemental!  Its not their fault!

8.  How does this bank expect the OP to have any kind of a life with just a $300 credit limit?

9.  Bobby, you are unaware of the discrimination which goes on in this world!  The root cause of this person's problems is because somebody doesn't like their race, gender, what street they live on, accent, ethnicity or shape/size of their nose.

Oh Bobby, if you can possibly find room in your wealthy heart, I urge you to please learn all about finance in the "real world".  But I doubt if you rich bank employees can!

Your Clueless

AUTHOR: Robert - (U.S.A.)

POSTED: Sunday, November 28, 2010

Sorry if this is too rough for you but you are totally clueless on how Credit Cards work.

When you got the card you agreed to pay at least the minimum payment each month.  If you do not you are not "paying as agreed", and will be reported late.  Being below your credit limit and being 60-Days late are totally separate items.  There is no credit rating for "I am doing what I can".

If they want $150 and you are only paying them $50 then you are NOT paying as agreed and will be reported late.  You are at $150 now because you did not make the previous minimum payment(s) as required.  This minimum will just continue to rise each month you do not pay the full minimum payment.  Because they take any unpaid minimum and add it to the next months payment along with a "late payment fee".

Now don't worry there is some "good" news for you.  If you continue to refuse to pay them, you won't have to deal with them much longer.  In a couple of months they will just decide to "Charge-Off" your account and sell it to a Collection Agency.  The Collection Agency won't hound you for any "minimum payments", they will just want the entire balance at once.  But if you don't want to deal with them and ignore your debt you have that right.  Since they will be a 3rd Party Collection Agency they are bound by the Fair Debt Collection Practices Act(FDCPA).  You can send them a Cease Communications letter and by law they can not call you, there are plenty of sites you can search for on how to write a proper letter.  Of course that doesn't make the debt go away but at least you won't have to deal with it...until they sue you.
