Becket.com charged an expired card to keep my subscription going after I canceled it 5 times. I had a screen shot of the expired card and the months I canceled and BOA made this statement.. EVEN tho they charged an expired card by searching for expiration dates that would make it charge...

We cannot intervene in situations involving a merchant's return, refund, or cancellation policy.
As a consumer, you're offered a certain level of protection against business practices from
merchants that accept credit cards as a means of payment. Merchants may operate their
businesses independently and set return and refund policies that best suit their business needs.
Consumers have the opportunity to inquire about the merchant's refund policy before making a
purchase, to ensure that it will offer them the flexibility they need.

Thanks BOA for letting a company charge my card that was expired for an account I canceled. They just lost a 25 year customer and I am closing all my business accounts with them...Totals of over 5-15k per month I used and paid them on time every time for 25 years... Have a nice day , going with a company that will not allow fraudulent charges on an expired card..

Stay away from Bank of America

Understand

AUTHOR: Robert - (United States)

POSTED: Friday, June 14, 2019

You seem to be failing to understand that I am not saying you don't have a valid complaint(and I dont' think the other poster is saying that either). I am saying that your complaint is not against the bank, it is against the merchant.

The bank did not give them your updated expiration date, that was provided through the credit card issuer. Once they have this your bank has no idea if it is valid or not so it will get approved.

Now, you claim that you cancelled the account. What proof do you have? Has this company provided you with a confirmation that you not only cancelled but they will stop any recurring charges? This is important for a couple of reasons. One to verify you cancelled it, and two that there were not some terms in the contract that allows you to cancel. For example if you agreed to a 1 year contract and in month 4 tried to cancel. They may have confirmation you cancelled, but they have the right to charge you for another 8 months.

If you are being charged and dispute it to the bank, without this written proof all the company will have to do is reply with the terms you agreed to that allows them to charge your card. Your dispute would then be denied, because they legally would then be  on the hook for any expenses if that merchant then comes back and it does get proven you in fact did owe the money.

I'm not going to go back and forth about what terms you did agree to or what you signed or didn't sign. I am just saying that this is why you are assuming that the bank should be doing things that they not only generlly won't do but in many cases legally can't do or have no control over.

Confirmation

Since they failed to observe your repeated requests to cancel the account it would seem like a good idea to obtain a confirmation.

Did you receive an email or written (not verbal) confirmation that your account was cancelled?

Right but YOU ARE WRONG

AUTHOR: Dave - (United States)

POSTED: Thursday, June 13, 2019

Subscription WAS CANCELED prior to the charge..Its as simple as that, nowhere does it state they are allowed to charge an expired card nor are they allowed to charge a card that had auto pay disabvled and canceled BEFORE the charge.. So get your facts straight

Incorrect Assumption

AUTHOR: Robert - (United States)

POSTED: Thursday, June 13, 2019

You are making the assumption that once a credit card expires that a company can no longer charge your card. The fact is that all of the major credit card issuers(Visa, MC, AmEx, Discover) allow merchants to request updated card information, including new expiration dates,  on recurring charges.

The bank the card is issued through has nothing to do with this.  This has to do more with the agreement you signed with the merchant  that allowed this, as not all merchants will do this.

If you are having charges made by a company you need to take your issue up with the company. Unfotunatly again, you can try to dispute it with your bank, but they will generally repsond that they have an agreement for recurring charges and your dispute would be denied. One other simple thing you can try is to either report your card as stolen which would issue you a new number, or as you did cancel the account all together.

Bank of America Is Correct - You Aren't

AUTHOR: Jim - (United States)

POSTED: Thursday, June 13, 2019

This is such a common occurance on ROR, there should almost be a boilerplate answer to your invalid complaint.

You cannot use a credit card company to exact leverage upon a merchant in a dispute.  Credit card companies cannot and will not get into the middle of your dispute with a merchant.  So when you file a dispute, the CC will ask the merchant for a copy of your card number and authorization.  Your merchant has that information which is why the dispute was resolved in favor of the merchant.

That's why the CC company said to you:  We cannot intervene in situations involving a merchant's return, refund, or cancellation policy.  That isn't just the policy of this credit card company.  Every CC company has this as their policy.  If they did intervene, then the CC company could be sued by its various merchants for breach of contract.

So what does a CC company protect you from?  It protects you from a merchant who breaches a contract with you, or someone trying to commit fraud against you.  That's all any of them do.  That's why the CC said to you:  Merchants may operate their businesses independently and set return and refund policies that best suit their business needs.  Consumers have the opportunity to inquire about the merchant's refund policy before making a purchase, to ensure that it will offer them the flexibility they need.  It represents advice to you as the cardholder to make sure there is no dispute regarding goods or services to be purchased between you as the buyer and the merchant as the seller.

...EVEN tho they charged an expired card by searching for expiration dates that would make it charge...  As long as the key information is correct (card number, name on card, billing zipcode, etc...), the card will be processed by most merchant systems out there, even if the expiration date happens to be incorrect.  If you believe you have an unscrupulous vendor you are dealing with, then you should have your credit card cancelled and a new one issued in its place.  You can call it a theft.  A merchant can't process a cancelled credit card no matter how hard they try.

going with a company that will not allow fraudulent charges on an expired card..  I guess for starters, it isn't a fraudulent charge to the credit card company or the merchant.  That's why there are investigations carried out by the CC company to determine whether it is, or not.  Second, you aren't going to have much luck with any credit card company in a similar situation, since they all have this policy.
