A word of warning to those of you that think you will get something for just filling out surveys...you are wrong...and it can be costly.

I fell for a pyramid scheme from a website with the URL www.freeflatscreens.com

To fill out some surveys, I would get a Free Flat Screen Tv or Computer Monitor. Everytime I would move up a level though, I would have to buy something.

After the "2nd Round", I finally figured it out that I would receive NOTHING.

Anyway, Belisi Clothiers was one of the companies involved with the scheme sucking you in with their $16.95 introductory offer for three ties (of low quality I might add.

If there is ever a case to look carefully at the terms of service for ANY club, this is the test case.

They have an offer on this webpage: belisi.com/offer_terms.asp

It is extremely misleading becuase unless you read what is beneath their "submit" button: Offer Terms (the same as above, just in legal language).

Then you will get screwed, royally screwed.

After I got the ties, I tried a few times to cancel my account, finally getting customer service on the phone to walk me through it.

I sent the merchandise and free gift back to them on December 31st (they received on January 4th)

On January 5, 2005, I received this email:

"Dear Jim,

I'm sorry that you are not satisfied with the quality of merchandise. Many people love the quality of our Belisi hand-made silk neckties.

Because you weren't satisfied and your introductory package is beyond our return policy, I'm authorized to waive 1 of the 4 additional purchases that you'd normally be required to make under the Belisi Necktie Club. This means that your account can be cancelled at this time provided that you keep the orders already reflected on your account.

Of course, you also may return your introductory shipment as long as its postmarked within 10 days of this email. If you choose to return your Introductory Package your Return Authorization Number is: 1481887-9109

I hope you will see the great value in this offer. We appreciate your business , your account has been cancelled from any further orders.

Sincerely,

Michelle

Customer Service Manager

Belisi Fashions, Inc.

NOTE: The above email is the final attempt to settle your account. The above response is based upon the reason indicated on your cancellation request. If you indicate that you do not accept the terms listed above, the full terms of the membership agreement will apply. Anything offered above that lowers purchase requirements or changes other parts of the membership agreement, if accepted, in no way affects the other terms and conditions of the full membership agreement, which will continue to apply.

Because we do our best to make it easy for you to contact our customer service department via our website http://www.belisi.com , we see no reason for you to initiate chargebacks with your credit card issuer. Chargebacks cost us money and man-hours and often only increase the time it takes for you to receive your refund. In the event that you initiate a chargeback for any reason with your credit card issuer to reverse payment we will (1) automatically cancel your account (2) send your account to a collection agency of our choice for recovery of your outstanding debt. The amount of the outstanding debt will be determined by the number of membership obligation shipments which have not yet been charged or that have been charged back, plus the full retail value of the introductory package, plus the full retail value of any free gifts you received, plus a $40.00 collection fee for each order for which a chargeback was processed by your credit card issuer." ----------------------------------------------------------I have zero merchandise, yet they will still charge me for three ties I don;t want and will not refund me...

A load of crap in my mind, but I called my card issuer MBNA and they tell me they do not think they will not be successful in getting a reversal and the company can go ahead and put me in collection anyway. --------------------------------------------------------- I probably will not get my money back, I will fight it to the max, but I am not holding my breath. MBNA really isn;t very helpful in this matter either. ---------------------------------------------------------- A word to the wise...stay far, far away from Belisi Clothiers. You will regret ever signing up with them.

This is amusing , I actually thought this guy had some sense of morals and common sense.

However, this is apparently a SCAMMER who apparently knows how the system works and he may be lucky enough to have had it work for him in the past. But people don't understand is,what goes around comes around, if you scam 1 company and get away with it, it doesn't necessarily mean it won't catch up with you in the long run. The company itself may not be able to do anything but someone else may. :

As far as collections and reporting you to the credit bureau, some companies may or may not do this.

But, like I previously stated what goes around comes around and if you want to be foolish and play the system and you are caught! Then , you will need to suffer the consequences- so be it.

One day your little fraudulent scam tricks may not work as well for you.

#8 Consumer Suggestion

Do you really think companies will give you free stuff just for answering a survey?

AUTHOR: Paul - (U.S.A.)

POSTED: Thursday, March 10, 2005

This is one of the latest scams to hit the internet. The survey con.

Idiots fall for this every time. Just the word free is enough to bring out all the losers who have no money to buy anything. They actually expect a company to hand out free stuff.

These crooked companies make it sound like you'll get an expensive item for free just by completing a simple survey. Nothing could be further from the truth.

In fact, you'll end up spending over twice what the item actually costs. Then, you may still never get the item you wanted in the first place.

For anyone dumb enough to fall for this, let me show you the way out.

DO NOT try to cancel from the fraud's site. They're not going to let you cancel. And, they won't send you a refund either. They'll just string you along with lies.

The way to get your money back is by going to your bank or credit card company. Do the chargeback, or reverse the transaction. Read more here to find out exactly what to say to the bank.

There is a special form you need to file whenever you need to reverse fraudulent charges.

This will hurt the fraud in three ways. First, they lose your money. Second, they are charged for the transaction. And, third, it jeopardizes their merchant account. After 2% of the customers demand refunds, they are put on a fraud list. After that, their account is closed.

This is exactly what needs to happen to these frauds. You don't go around taking money and telling people they'll get free stuff. That's fraud. They deserve to be put out of business.

Don't worry at all about being sent to collections. First, no collector will buy a fraud's crooked billings. They know they won't get one cent from them. So, they won't buy the accounts.

They won't report you to the credit files either because that will cost them money. It's not free to make credit reports. People who file them have to pay big bucks.

Plus, they don't have your social security number anyway. So, what does it matter?

If you get caught in this survey scam, use the banks to get all your money back as soon as you wise up.

Then, stop looking on the internet for free things!

Main Issue--Consumer Failed To Read Both Websites

AUTHOR: Director Of Customer Service - (U.S.A.)

POSTED: Thursday, March 10, 2005

I cannot be specific on the account we are referring to as I do not have enough information to access the account in question. However, by reading the consumers complaint I can comment as to what may be the case and the reason why this consumer is so unhappy with the situation they signed themselves up for.

This consumer has apparently caused the issues at hand by not reading and understanding the agreement that they signed up with through the affiliate website and our website.

I would like to first point out, that, nothing in this world is for FREE.

There are sponsoring companies supporting the incentives that these consumers attempt to qualify for. These are companies that join the affiliates in their marketing efforts, are listed under the required offers to qualify for the gift and contribute fees toward these free gifts in exchange for the consumers' orders through their website.

How else would a company remain in business?

Certainly not by just paying another company fees to just to give away expensive electronic equipment like computers, TV's IPODs etc. Just simply by having a consumer visit their website, place an order for $3.00 ties and cancel it.

This consumer, according to his complaint, had signed up with the affiliate first, which is how the offers are arranged, agreed to their terms, opened an account with them and then, was directed to our website by the affiliate. I will first indicate the terms and conditions briefly that they agreed to when opening the account with the affiliate:

http://www.freeflatscreens.com/

http://www.freeflatscreens.com/Terms.aspx

Terms & Conditions

FreeFlatScreens.com

Terms and Conditions:

Use of this website assumes that you fully accept and agree to the Terms and Conditions set forth in this document. These Terms & Conditions also state that by signing up, you are certifying you have read and understand our Terms & Conditions as well as our Privacy Policy. Furthermore, you are agreeing to the contents and conditions listed in each......

Some websites developed by Gratis Internet are based on earning "Points" and exchanging those points for free items. Others, however, are based on completing an offer, and referring a certain number of friends who also complete an offer. This distinction in requirements is important and certain terms in this document apply to point-based sites while others may apply to referral-based sites......

II. OFFERS

(b) The user must complete the offer by clicking on the offer from this website and nowhere else (including any of our affiliates, competitors, or the offer provider's website). Users must click the offer link via our page in order for us to correctly track and credit for a user's offer completion. Note that some applications like spyware blockers, or popup blockers may preclude these links from functioning correctly.....

4. Eligibility for Receiving a Free Item for Referral-based websites....

(a) For this particular website, FreeFlatScreens.com, users must do the following to be eligible to get approval to receive their free product:......

i. Complete and get credit for at least one offer themselves

ii. Refer at least 8 unique people who join and also correctly complete an offer under the terms listed in this document.

(b) After a user signs up with our website and successfully completes an offer, they must get 8 people to also sign up with our website and successfully complete an offer to get their free item. In order to connect these referrals to the original user, we issue this user a unique link to our offer site, which they must then distribute to the intended parties. Thus, the user is entirely responsible for all communications regarding our offer sites. At no point during the offer process does Gratis Internet send out any communications on the user's behalf to encourage such signups to occur.

(c) A user may complete more than one offer and may refer more than 8 referrals, but cannot earn more than 1 free product with their account. Any additional referrals or offer completions will not result in any additional free items.

5. Eligibility for Receiving a Free Item for Point-based websites

(a) Users must earn points by completing online offers. Each offer will give a user a specific amount of points upon successful completion. These points can then be used to "purchase" various items listed on the website.....

III. ORDERS

1. Receipt of Product

(a) After a user completes the steps required to receive the product, Gratis Internet will take measures to ensure that the user receives orders within a reasonable amount of time. Delivery times vary amongst product suppliers, but most orders are received within 30 days from placing the order.....

V. HOLD

(c) Negative feedback from one of our affiliates or offers being completed and immediately canceled....

2. Contacting Us

If a user chooses he or she can contact us at the following postal address:

Though Belisi Fashions is not in anyway connected with this affiliate or their terms, I personally went to the website to review the terms and conditions that were present when this consumer went and opened an account with this advertiser and proceeded to qualify for their free gift. The terms directly state that there are additional offers required to fulfill their agreement in order to qualify for the incentive, it was disclosed to them. But in all agreements and contracts, you need to take the time to read the obligations of the terms disclosed to you.

In regards to the issue with Belisi Fashions, our advertisement for the Belisi Necktie Club was just one of the many offers listed in the choices that the consumer could choose to fulfill in exchange for the incentive points towards their free gifts.

This consumer for one chose to be involved with this affiliate, chose to visit our website and chose to place their order.

The consumer seems to be pretty well aware of the terms and conditions as they provided the link to the terms and conditions that were disclosed to them prior to placing their order. First of all the page the customer is referring to indicated the following:

http://www.belisi.com/offer_terms.asp

Save 95% on Your Introductory Package!

Through our promotional offers you get Belisi Hand-Made Silk Neckties for 95% off or more. See specific offers for details. You'll always be given a summary before submitting your order showing your exact costs. Also, with some of our promotional offers you can enjoy free gifts with your promotional package.

30% Savings on Your Additional Shipments!

When you join the Belisi Necktie Club, you agree to buy four more Belisi Neckties over the next 2 years at $24.50 or more plus shipping, handling and processing, and you may cancel anytime after doing so. Belisi Neckties are offered through the club at a 30% discount off our regular prices, so you can purchase items toward your commitment - - and continue to save at the same time by ordering neckties through the club at a special discount

The bottom of the page has a text box which has the entire printable version of all the policies. You do not need to read this text box to understand that by joining the club you are agreeing to the additional purchase commitment.

I will also comment that this apparently did happen during the holiday week in which this customer requested to cancel their account, in which our office was closed. Therefore this customer's inquiry was replied to upon reopening of our office from the holidays.

In order to get the email referencing the quality of our ties, the customer would have had to submit a cancellation request indicating that they were not happy with the quality of the ties. This is the email that the management team utilizes to resolve an account according to the reasoning that the customer requested to cancel their membership. This email gives the customer a choice under our satisfaction guarantee:

One, Keep the Introductory shipment and make 1 more purchase, the final 3 purchases of the 4 are waived.

OR

Two, Return the shipment within 10 days of receipt for account cancellation and a refund.

If the customer returned the shipment, then he would have immediately received a refund to his credit card upon receipt of the package into our warehouse. If he did not receive the refund, then this means our department has no record of the return. In order to remove his account from collections in this case, we would require a simple confirmation receipt from the post office indicating that the merchandise was accepted by our warehouse.

According to the customer he states that we apparently received this merchandise back in our warehouse on January 5th, so, if the customer has record of this return, then all he would need to do is provide our department with the receipt from UPSP showing the delivery to our warehouse and his account would be removed from delinquency and a refund would be issued to his credit card.

The other issues this customer faces with the affiliate due to him placing his other orders would need to be taken directly up with the affiliate that is responsible for his account and his free gift. Contact information was included above.

(c) Negative feedback from one of our affiliates or offers being completed and immediately canceled....
