Berns & Weiss attorneys Collected millions from class action lawsuit, we were left out in the cold. Woodland Hills, California

For the last three years we have tried to get a loan modification. Since late 2007 we have been in a
Pick-a-Payment loan with Wachovia. In 2010 we had financial challenges and contacted Wachovia for assistance. They suggested a loan mod. They said we more than qualified and after two months we received a letter that a new escrow account had been opened. Three days later Wells Fargo cancelled it. No reasons. All that time they told us NOT to make any payments because the money would not go towards the account. We were charged late fees and our credit ruined. A loan audit shows violations of TILA. A certified copy was sent at the time and Wachovia did not respond. Never.

In February 2011 we contacted them again and were told they could not talk to use due to legal reasons. Unbeknown we were made part of a class action suit. 26 attorneys representing, or should I say  using, 519000 people in the same predicament. Weve been had again.



Judge Jeremy Fogel, San Jose, CA court, awarded the attorneys 25 million, we received $178.00 (never cashed) and no legal representation to get a loan mod. Berns & Weiss contacted us in January 2012, basically they were going to try and hold Wells Fargo responsible for the loan mod. However, they wanted written proof that we again asked for a loan mod and were denied. Never mind that we had contacted FTC after no response to TILA violations letter. And never mind that on Berns & Weiss website is said not to contact the banks. Never mind that everyone knew that during those years no mods were offered.

I contacted Obama, Schwarzenegger, Benoit, Mary Bono, FTC, Kamala Harris and not one person holds
any of these people responsible for this horrible deceitful law practice and banks collecting money from the government supposedly to help us, are just like the attorneys involved, just to line their own pockets. Arbogast, Berns & Weiss and other 23 attorneys involved should have their license to practice
revoked.

For a year Berns & Weiss kept us dangling, they did not have the guts to let us know they would not represent us, instead of 51900 on which they already collected, they are now only representing 30 people? We were pushed around from one paralegal to another and after three months they noticed 2010 for loan mod request, not what they wanted... written communication from 2011/12 but remember we were not to contact the banks. We were told to be patient, a lot of people involved.

Really. They bit off more than they could chew?

We went to Wells Fargo yesterday and spoke with a person regarding a loan mod. She was made aware off the fact that we were part of the law suit. She told us case was closed, attorneys received money and therefore Wells Fargo is not responsible. Go figure. A killer goes to court, found guilty, case closed, the killer goes free because he is no longer responsible. We were raped by the banks and then by the attorneys. What all of this tells me..... the government and court system grossly failed to protect people, but said OK to banks and attorneys to hurt us. I am furious that they can break the law and are not held responsible. I seriously wonder if any one took a pay off.

I wish we could find a real/honest attorney (are there any?) to file a law suit against Wells Fargo as well as the attorneys for years of pain and suffering and in the meantime we are still in a fraudulent mortgage.
