Hired Mr Cagni for a remodel job on my house. Not only did the work drag on for 6 months after the completion date but in the end was left unfinished. It turns out that Mr Cagni was not paying his subcontractors or workers and thus no one wanted to do the work. In addition, project supplies and materials could not be ordered because Mr Cagni could not afford the deposits.

Mr Cagni has performed criminal behavior. Fla. Stat. § 713.345 related to the misapplication of construction funds which states in relevant part: 

“A person, firm, or corporation, or an agent, officer, or employee thereof, who receives any payment on account of improving real property must apply such portion of any payment to the payment of all amounts then due and owing for services and labor which were performed on, or materials which were furnished for, such improvement prior to receipt of the payment.”

You would be a fool to hire this contractor without doing a complete and thorough reference check, which should include speaking directly with homeowners as well as past suppliers. Check the Public Records on the Pinellas County website for Notices of Commencement and go directly to these homeowners for references. You will discover problem after problem after problem, a trail of unpaid subs and suppliers, workers who never got paid, and on and on and on.
