I want everyone to know that Cambece shouldn't be allowed to practice law anymore because of what they do and say that isn't legal.These collectors are violent, threatening, and even show up at your house to demand payments.

What kind of place is this? They should really be investigated by the state police because they do not follow the FDCPA regulations at all.

They talk about law suits and garnishment, and also say things like we will find you and make you give us the money that you owe. I just don't understand how this is legal. What kind of lawyer runs this so called business. It sounds like a bunch of kids with no education who work there. What advice can someone give to me?

Like my title, I would like to express my thanks for the advice u have given me and to everyone else who has been victimised by Cambece. 1st., you are right about these "lawyers" being illiterate, judging by the rebuttals frm them; i can't understand anything they were saying. It's as if they were typing 50 w.p.m. with 0 to 1% accuracy.

In my situation, I have not made any kind of payments to them, nor discussed any kind of arrangement at all because i'm currently unemployed. Besides, any kind of arrangement wouldn't benefit me in any kind of way, nor would it be affordable without getting my car repossessed and causing me to starve to death.
I want to add, to anyone else who's being hounded by these wankers, or any other collection agencies, 1-rent a p.o. box and use it for any kind of dealings you have with any place, or anyone outside your family and your personal social circle; unless the fee has gone up, the post office will charge a $20,00 fee for a box good for 6 months--i plan to get 1 in the near future. 2-if u have a cell phone with a good plan, use the number in place of your home number and say that it's the only number you have; in this day and age, I don't consider it lying--with the problem of ID theft, burglaries, and home invasions running rampant, it's never a good idea to give out your personal info. anyway. Lastly, if u have caller i.d. and an answering service/machine, constantly use it to your benefit--if u don't recognise the number on your i.d., let the machine/service take the call. If you are staying with some people, and they normally answer the phone, politely instruct them on the proper way to answer the call. If the caller is asking for you, the person in your household should say,"I'll see if he/she's in, may i ask who's calling?" The caller should identify him/herself. If the caller is someone you know and would like to speak to, by all means, take the call. However, if it's someone you are not familiar with and don't wish to speak to, have that person who answered the phone to go back on the phone to say that you're not there and take a msg, or give the caller an alternate phone number of your choosing.

For me, i find it difficult to utilise that last statement about others in the household who answer the phone, because i stay with parents. I love them dearly, but, i'm afraid that they are uneducated, and stubbornly refuse to be educated in proper phone answering etiquette; they will either a-call my name out loud, the caller could hear it of course; b-hand the phone to me and say,"here, it's for you.", caller could also hear that exchange of course; c-not get the identity of the caller; or all of the above. Above all, they don't even bother to sign up for caller i.d. That's how i accidently wind up speaking to these wankers at these collection agencies, wind up getting irritated to stressed out, and have to use "spin control", like saying that home number's not good for me and giving them an alternate number.

Above all else, speak to an attorney in your city/town who gives either a free consultation, whether in-office, of by phone. Even better would be if you, or your family already have one on retainer who won't charge x-tra for this type of consultation. He/She would be able to layout the best possible solution for you; may even find a better alternative to filing for bankruptcy.

Response to the collector "Pay your bill":

First of all, BEFORE you can ever claim to be a PROFESSIONAL [not "professinal"], you need to learn how to use capitalization, and proper grammar, AND most of all, learn how to spell. You are the typical uneducated borderline illiterate moron that occupies cubicles nationwide. This is the FIRST thing wrong with this industry.

Your entire post is filled with jibberish and nonsense, typical of a bottomfeeder. It makes no sense at all. If anyone can actually read and understand it!

Yes, we CAN just walk away from credit card debt, AND get away with it!

You obviously haven't read any of my prior posts over the past few years. I walked away from $170k in UNSECURED debt. And, as of today, have beaten every single bottomfeeder that has come after me! Including CAMBECE!

When lenders start practicing RESPONSIBLE LENDING, I will start advocating more responsibility from the debtor.

And, your logic is flawed, if a person is making a payment on a $40k car and a $200k home, that leaves LESS money to pay other obligations. This in no way indicates more ability to pay! That is typical crackhead logic.

This is exactly why you NEVER speak to any third party debt collector / junk debt buyer on the phone!! AND, most of all, NEVER make a payment or payment arrangement!! This will validate the debt to them! This is what they hope for!

Now, that you have made a payment, you cannot dispute the debt, as you have legally validated it. They can now sue you and win, where before they most likely would not have been able to.

You do not need a lawyer to send a letter to a bottomfeeder. You simply need to send a CEASE COMMUNICATION request under the provisions of the FDCPA.

This letter needs to be sent by certified mail, return reciept requested. And always put the certified# on the letter itself to prove exactly what you sent. This procedure is very important!

The fact is that MOST bottomfeeders will NEVER sue, as it is costly and time consuming.

Debt collectors to pay $75,000 settlement
Peabody law firm also to implement new procedures

After a two-year investigation based on more than 100 complaints, a Peabody debt-collection law firm will pay $75,000 and implement procedures to protect indebted consumers under an agreement unveiled yesterday by the state attorney general's office.

Thomas F. Reilly, the attorney general, alleged that representatives of the J.A. Cambece Law Office PC violated state and federal debt-collection laws by using profane language, placing calls to consumers at improper hours, making unauthorized communications with consumers at their places of employment, and failing to provide proof of the validity of debts.

The settlement "imposes restrictions on this firm to protect consumers from abusive practices," Reilly said in a prepared statement. "It also sends a message to the collection industry that abusive tactics will not be tolerated."

In August, the Globe reported that Cambece was being investigated by the attorney general's office. At the time, Nancy Sterling, a spokeswoman for the firm, said the investigation was "based on a small number of complaints."

A Globe Spotlight series in July and August revealed widespread abuses in the debt-collection industry, but the series did not focus on Cambece.

Under the agreement, filed yesterday in Suffolk Superior Court, Cambece assented to a variety of procedures designed to protect debtors. These include recording all telephone conversations with consumers, providing proof of debt -- including at least two monthly statements from the original creditor -- and appointing a supervisor to oversee compliance with state and federal laws.

The settlement also requires Cambece to pay $20,000 in restitution to consumers, $45,000 to a consumer aid fund managed by the attorney general's office, and $10,000 to cover the cost of the state's investigation.

In his statement, Reilly said Cambece cooperated with the investigation. But the firm denies it violated any laws.

"There's no finding by any court that Cambece broke any state or federal law," said Sterling, the spokeswoman for the firm.

The filing "simply confirms a voluntary agreement between the Cambece law firm and the attorney general's office. No enforcement action was filed against the law firm, and no fines or penalties were paid."

yes their are late fees and yes their is a big interest rates no its not ur fault u fell behind but u need to pay what u owe .. i call can try to help people because i am a professinal at what i do ... their is no need to harrase or bash someone to pay their bill ...

if u live in mass with cambece yes u can and mostly will be sued ... this is his state of practice ..

Christine,

First of all, if you STAY OFF THE PHONE, it makes it very difficult for them to violate the FDCPA, right? NEVER speak to any debt collector on the phone. NEVER!!

Second, since they are "attorneys", you need to file a written complaint with the Bar Association. This is the best thing you can do. enough of these, and they get disbarred. problem solved.

Go to FTC.gov and file a complaint online for EACH violation of your rights under the FDCPA separately. This is a permanent record that will most likely bring future enforcement.

The State Police have no jurisdiction in this matter unless they actually came to your house and engaged in an act of violence against you. Here in FL I pray for one of these crackheads to show up at my door. I love our use of deadly force law here. No repeat offenders at my house.

Cambece hires the lowest of the lowlife. Druggies, alcoholics, felons, etc. Puts them in a little cubicle with a phone and pays them nothing. These are mostly people with very low intelligence and low self esteem who enjoy doing this as it gives them some percieved power and an ability to "get even".

Next time they call, pick up the phone and sharply blow a police whistle in the ear of the crackhead on the other end and hang up. Do this every time they call. Then you get the satisfaction with the mental picture of a crackhead in a cubicle with his ears bleeding.

Works for me.
