I purchased a car from Dallas Kia in October of 2002 for my son so that he would have a reliable vehicle. All of the payments were made in a timely manner.

In January of 2003, I fell behind by one payment after the death of my father and I made that payment up as quickly as I could.

In March of 2005, Capital One stated that no payments had been made on the car since July of 2004. I was shocked and outraged and immediately called their customer service (which is nothing but a joke). On April 5, 2005 I faxed them copies of all of my cancelled checks and bank statments showing that my payments had been made and that they had cleared my bank. The only payments that were missing were the check from December of 2004 (never could find where they cashed the check), the February 2005 which was paid with a money oreder that they cashed and erroneously applied to someone elses account, and the May 2005 payment which I issued a stop payment on because of their misappropriation of my account.

Nothing was done until May 31, 2005 when one of my many account managers (another joke as I swear that there is only one person making up all of these names)told me that they had finally applied all of the old payments that they could find. What she failed to tell me is that they falsified the records and applied the payments using all of the dates on the backs of the checks that I faxed them copies of more than once.

On June 1, 2005 one of their many made up names called me and told me that they were going to pick up the car from me for non-payment. I argued with them and finally ended up sending them a money gram on June 2, 2005 for $700.00 (all of my paycheck). By June 4, 2005, they managed to loose my $700.00 payment and on June 16, 2005 I did a pay by phone of $500.00. In looking at the payment history that they sent to me, my balance was $11,311.11 before the $500.00 payment and the $700.00 which I made them find and remove from the account that they had erroneoulsy applied it to. It then went down to $10,865.12 and 30 minutes later (the payment history is time stamped by the computer) it was back up to $11,311.11.

I can not get Capital One to respond to any of my phone calls and none of their high school drop outs who work there can explain the mishandling and misappropriation of funds. They will happily tell me that "This is what happens when you rely on the US Post Office; the check does not magically appear from your mialbox to ours".

I have kept detailed information and copies of all correspondence, phone calls and transactions with Capital One to the point that I now have a file as thick as War and Peace (which would be easier to read at this point). I have filed with the BBB (to no avail). I am going to send copies to the Virgina Attorney General, Texas Attorney General, US Attorney General, IRS, and any other federal agencies that I can think of. Hopefully some attorney will take on a class action suit for all of us that have been harrassed and wronged by Capital One. By harrassment, I mean that they will call me 7 to 9 times a day on my cell phone or at work and hang up when I answer.

If I had known 2 1/2 years ago the way Capital One did business, I would never have used them. I would probably havce used a loan shark first and made out better. My health has suffered and my sanity is long gone. My family has suffered as well.

My son is in the process of buying a new car. He was offered a loan through Capital One and told them where they could put their loan after seeing what they have put me through.

My best advice to anyone buying a car whether it is newr or used, DO NOT USE CAPITAL ONE. They lie, cheat, and steal. They also harrass you and have no grace period.

There Is no need to speak to people so rudely.  There Is a nice way to correct people.  You will not get many people to do what you say.  If you speak to them that way.

There customer services representatives all have American names, but they speak with Indian accents.  Do not expect to get any satsifaction from these people, the situation that you are speaking of is not one single incident.  We have been victims of the very same practices.  Calls every day from 8 a.m. to just before nine at night, sometimes 15-16 times a day everyday.  I finally had to write a cease and desist letter to them.  They have lost payments of ours also and when I called them on this, there answer was.. Prove it!  Well the payments were made automatically through my daughters bank account.  We had fallen a month behind due to unforseen circumstances as well, we finally made the payment by making two payments at once also made several payments more than needed to make up for there ridiculous late charges.  Still they claim that we are behind.  They are awful and I would not recommend them to anyone.  The do have customer service centers in the US and I have heard that if you request you can be forwarded to one of them.  I told them point blank that we would not pay the late charges and to put them on the end of the loan.  I agreed to pay the loan and that is what they are getting.  I think you are right in saying there is only one person or maybe two a male and a female and the name is usually Steve, Martin or some other name.  LOL  ANyway good luck to you in endevour to straighten out your account.  I should think it would be up to them to prove the payments were not made.  Capitol One is just the administrator for Onyx... by the way.
