I have been unemployed since October 2004 and was making my payment through November of '04. Since then I was getting weekly calls from Capital One collections and they were pretty understanding. As Of July My account went into default and that is when everything began to get worse.

RMA collections out of Buffalo, TX took over the account and then my phone began to ring hourly seven days a week. Even talking to someone didn't get them to turn off the auto-dialer. This would cease at 8:00 PM every day. I would try and talk to a manager or supervisor and either they would place me on hold or hang up. I would pick up the phone only for them to hang up on me.

Today I tried to call Capital One to speak to their Collections Group and the phone diverted to RMA. I did speak with a supervisor today and she supposedly took me off their call list.

I then called Capital One's 800 number again and by not entering my account number did I get a person actually working for Capital One. I explained to her what was going on and was informed by her that she was unable to give me that information and that I had to speak to RMA. I told her that I will not work with RMA as they do not have my trust and I thought Capital One would want to know how RMA does business. she said I would have to deal with RMA.

Collection Agencies

I'm sorry to hear you aren't happy with the collection agency that Capital One uses. I used to work for a credit card company so I can shed a little light for you.

It generally takes up until the 6th billing cycle of no payment for an account to be sent to a collection agency. Once sent to a collection agency, it is totally at the discretion of that agency to make collection efforts. The original creditor from that point forward has nothing to do with the account anymore. They were telling you the truth when they told you they were no longer holding the account.

Basically credit card companies use the collection agencies to do their dirty work. Really it is a necessity. I am certainly not saying you are one of these people but there are tons of people who never pay their bills with the original credit card but get scared when they realize it went to outside collections and pay it. The way they see it is, they aren't going to be nice about it anymore so they send it off to other people to handle it for them. Really, they won't care if you think that agency isn't being nice to you or treating you the way you want them to. Now if they are cussing you out and calling you at 1 in the morning, they are in violation of banking regulations. Pretty much if they aren't doing that, Capital One won't be worried about any complaints you have with them.
