CAPITALONE AUTO FINANCE Capitalone repossession without notice.Laws should prevent certain repossessions. I'm extremely concerned with Capitalone actions and the state trooper that assisted in the operation of towing. Piano Texas

I did not receive noticed and I'm extremely concerned with Capitalone actions and state troopers who assisted in the operation. Capital One Auto Finance, repossessed without any forms of written letters or documentation of default. State troopers assisted them and did removed car from driveway by use of threats and verbal force to arrest. Troopers used threats to arrest for obstruction of justice, if I do not get out of the vehicle, trooper stated, "he'd break the window and placed me under arrest". Troopers should not assist themselves in a civil matter and towing should be achieved only by peaceful means by the tow driver.

Okay companies that do reposessions do not as general practice have State Troupers involved in the Repo.  So this tells us one of a few things. You gave the Repo Company some indication that you were not going to let the car go easily, which would blow your claims of not being notificed.

When the Repo company came you caused a disturbance or made threats, which blows your claim of wanting it by "peaceful" means. You hid the car causing them to go to court and get a court order, which destroys any "honesty" you are trying to claim.

The fact is that almost without exception a bank is under zero requirement to tell you they are reposessing the car.  When you got the loan you agreed to them being able to reposess the car if you failed to pay..that's all the notice they need.  There was no conditions that if you had one of 1001 "hard luck" stories they have to "work with you".

So your claim of thinking it should be by "peaceful" means as it is a civil matter obviously holds as much weight as the promise you made to make your payments on-time and for the full amount when you signed the legal agreement.

I suppose the repo was thru no fault of your own, was it?  You made each and every payment on time, every time and had the car covered with proper insurance when the big, bad lender decided to pick on you to do today's repo?  Is that how it was?  Or...did you try to hide the car thus attempting to obstruct justice thus involving law enforcement?  No lender is so stupid as to give an acknowledged deadbeat advance notice of a repo so the sorry deadbeat can hide, damage or destroy the car.

 

NO RIPOFF HERE--Complainer obviously defaulted on loan thus causing a repo.
