I have a car I am trying to trade in and the dealer said there were two accidentstructural damage records on the CarFax for vehicle and cannot give a fair value for the car. Checking the carfax I found that the second accident is correct - it happened when I was owner. But the first accident is recorded just a month earlier - the problem is, that accident never happened. I have given CarFax enough proof of insurance, have them talked to the insurance company I had at that time but CarFax refuses to remove the first accident. They are unwilling to tell me how it was recorded, which insurance company may have filed it, was it pulled from a DMV or police source - nothing that I can use to understand what might have happened. In fact, carfax did not even have the 2nd accident on their records UNTIL I mailed the the repair work done for the second - they immediately added that in. What I did in good faith was turned against me. I have extensive email threads under Case#: 01151947 with them but they refuse to share any further information or correct the record. I have filed a request with the BBBY and also State of Virginia consumer departmern to see if I can get some answers.

You spend the entire first part of your report talking about how there are 2 accidents on your CarFax but only one "real" accident.  But then you drop a bombshell and say that YOU reported the 2nd accident...in good faith.  WTH?

First of all when exactly did you submit what we should probably call the second accident?  According to your report it would have had to have been before you went to the dealer because the 2nd report was already on there.  But the only way the 2nd report would have been on there is if you reported it..per your report.   So did you really report it "out of good faith" to a company that has zero governmental authority and you are not even required to report to?

Now you seem perplexed as to why there is a "phantom" accident.  Well did it ever occur to you that the 1st accident you say is not real..is actually the second accident reported from a different source?  You claim you send them documenation on the insurance company.  Well again this may be news for you but many people do NOT report accidents to their insurance(fearing their rates will go up).  So it is very possible that is why they are basically ignoring you on that claim.

Also, in California it is State Law that if you have damages over $750 or anyone was killed or injured you must report it to the DMV on form SR-1.  So you may want to contact the DMV and see if you can get a report on your VIN to see if there is a phantom accident out there.  This also may be one source where Carfax is getting it's information.

Like many companies their information may be considered proprietary, and it would take a huge court battle to try and get this information from them.  But in your case even if you found it, it would unlikely do you any good.  As you also seem a bit upset that because you have TWO accidents with structural damage you can't get fair market value.  Well I have news for you..even if the one accident YOU reported was the only one on there you still wouldn't get fair market value.

 Someone else may have reported an accident against someone with a SIMILAR vin number. Or they may have transposed numbers. Realistically THEY don't have to tell you ANYTHING as its part of HOW they run their business model. What this means for YOU is that while YOU want their source, THEY DO NOT HAVE TO PROVIDE IT TO YOU if it violates their internal policies and processes. Its kinda like asking KFC what the EXACT measurements of their 11 herbs and spices is. They don't/wont give it out. Its to protect EVERYONE involved. So maybe try and work WITH them instead of making demands ON them. You get much farther in ANY situation by NOT being that self entitled dillhole over the phone or on emails. YOU are trying to do ALL of this remotely. By remotely I mean NOT in person. Part of the problem with using the web is that it is IMPERSONAL!!! Meaning that the people YOU are dealing with DO NOT have to have empathy or understanding. YOU are NOT right there in front of them. YOU are just a string of words on the screen for them. I know its frustrating, but it IS what it IS!!! Be patient, just because YOU can contact THEM immediately doesn't mean that YOUR problem is being worked on. There ARE other people ahead of YOU and when THEY can THEY will address your issue. Until then try and be patient and work WITHIN the system and escalate the problem by speaking with supervisors. Also YOU can give up on the BBB. THEY HAVE NO TEETH!!! All YOU have done by making a BBB report over a issue not completely under their control, is cause THEM to give even LESS of a d**n!!! YOU want IMMEDIATE satisfaction. While your websites load fast, the rest of the world IS NOT as fast as the web. Try and remember that please!!!
