I had been without full coverage insurance a couple months (from March-May) on this car purchased. I spoke with Carl Burke who told me to get the full coverage when I could.  

While without the insurance this car was not mobile and was garaged and I drove my Mercedes Benz since per the contract liability wasn't good enough. Carl had stated to me that he has GPS installed on the car so he knows this to be true.

On May 24th I upgraded the insurance to full coverage through Allstate. On 6/17/13 I went into the dealership to make sure the owner Carl Burke had received my proof of insurance and to make my payment.

He had no problems taking my payment at all but stated that the secretary "Sue" was on lunch and he would have her call me to make sure they had the up to date insurance information.

Today these people towed my car from outside of my husband's job and when I called I was repeatedly hung up on by both Sue and Carl Burke himself, after Carl called me a liar.

I got on the phone with Lois at Allstate and she verified the coverage. Sue was very rude to her as well!

They unlawfully towed my car which is current on the car note and has full coverage insurance. Carl Burke Premium Autos is a rip off and a thief and him and Sue are extremely unprofessional! I will SUE THESE PEOPLE IF THEY DON'T GET THAT CAR BACK TO ME IN TODAY!!!

I didn't respond to the other response because I understand that people have no idea about contractual guidelines. They returned the car to me as soon as they received the complaint from the Better Business Bureau. In response to the other person's response, the only way to tow a car is if you are in violation of a contract at that time. Thank you for your response, it helped. I will never do business with them again. I owe $5000 on the car and this didn't start until we were almost paid off!

 If your Finance contract requires FULL coverage insurance, and you are without it...YOU are in default.  It doesn't matter if at a later time you get coverage.  The only reason they didn't repo your car before this is because you had it in a locked garage, which if they had reposessed it then would most likely have been breaking the law.

The interesting thing is that you said that there was a GPS tracking device.  These are only used by Sub-Prime lenders to people that have not proven they can handle credit.  Yet you have a 2nd car which is a Mercedes.

Just be lucky that they didn't put "Forced Placed" insurance on your vehicle.  That is something they would have had every right to do, to cover their liability because you did not hold full coverage.  Oh and why is forced placed issurance so bad..because the cost of it can be as much as several hundred dollars a week.  And you would legally owe this amount or again..could be considered in default.

As a car are you are missing the boat.  You my friend need to do a drive-by and take pictures of the dealership and post those on your report.  If the dealership is unwilling to honor their word you need to expose them by posting photos of the dealership in question mentioned names of the dealership employees email addresses and phone numbers.

If you post the name of the dealership exactly as they are registered with the Arizona State business registry. Sooner or later Google will pick it up and they will be revealed if they don't take care of you.  If they are not willing to honor their word of the deal they need to be exposed.
