I bought the a really nice car from carmax and traded my other car in. I was so happy for a week or two. They then had told me that the bank did not finance me and that I would have to go get financed somewhere else or else they would have to take the next step. I was really miserable when different people had called making threats, such as they would have to take the next step.

I was really frustrated because why would they give me a car and then ask for it back. It sounds like they messed up on their end. I have a two year old and how am I supposed to get to work with no vehicle. Now I have no clue what I am going to do. I am really devastated.

Jacked Up The Interest RATE!!!!!!!

AUTHOR: Michael - (U.S.A.)

POSTED: Wednesday, July 23, 2008

I went into Carmax yesterday to do the resale and that was a bunch of bull. A re sale is where they make you sign the car back to the dealer and tell you might not leave with the car if the bank does not approve you. I had told the HEAD SALES MANAGER they were in breach of contract. How do they let me leave with the car and repossess it with out me being able to make one payment. I had repeatedly asked the SALES MANAGER if this was some sort of spot delivery and he looked at me as if I were speaking blasphemy. He had told me "We don't spot deliver cars." LIARS!!! I was really devastated to know that i was going to leave the dealership car less.

Once he put my application through again he had told me I was approved at higher interest rate. From 11% all the way up to 18%. I was really desperate so I told him that would not be a problem. I had repeatedly asked the SALES MANGER how had the previous approval go null. He had told me when they called my job, which I have been employed here for two and a half years, they could not prove my employment here. That is a bunch of bull!!!! A few weeks prior to going to Carmax I had received an approval from another dealer. When they had called my job the owner of my company had spoke with the bank and had verified my employment. There are also two more mangers here that would verify my employment and have previous times before.

Something went really wrong here. For future references when you go to sell your car to Carmax be aware of these sneaky, scavengers, worm, bottom feeders. To know that I just went there to sell my car and was literally raped. The car salesman had asked me "What car are you interested in". I had told I'm already financed at a different dealership with a 2005 impala. He had freaked and told me "We have Impala's. Lets go check them out." I had insisted to the slime ball that I was approved at another dealership but they don't care about that. To them I looked like a giant meal ticket. I blame myself. I should have never let this con man get the best of me. JUST REMEMBER BE VERY CAREFUL WHEN YOU GET A CAR FROM THESE BOTTOM FEEDERS. THEY WILL SHRED YOU TO PIECES!!!

WOW!!!!

I have gone to Carmax and gave them all my information regarding my yearly income for the last two years. 2006 and 2007. It all check out correctly. Then on top of that they asked me to get my tax return from my accountant. Which the accountant had told that sounded far fetched that the bank needed that information. I submitted my tax return to Carmax. It supposedly checked out fine. A week later I get another call from Carmax stating that they need to do a resale. WTF is a resale. They told me I have nothing to worry about because I wouldn't have to pay my first car payment for another month.

Mind you I work 9:00 A.M. to 6:00 P.M. everyday. But these people want me to go back into their dealership and fill out paperwork for a resale. It makes no sense to me. These people have screwed up and screwed me so bad and they want me to be there little puppet. I had gone to the dealership last night after a long exhausting Monday and the guy was not even there. I was so pissed to find out this guy had been harrassing me all weekend while I was on Vacation. Through the whole weekend all he could tell me "We need you and the car back here A.S.A.P. in order to do a resale." I had specifically told the guy I was out of town on vacation and there was no way I was going to be able to bring the car in until Monday. So when I did finally bring it in Monday, the jerk was not there.

This morning the guy had called me threatning to send out a repo order out if I do not come into the dealership again today. I had told the guy I was there last night and he had left early. He had told me if I do not come in today he will send a repo order out. I guess I have no choice but to go back there again today. I know anybody who reads this will probably break out the violins. But please do not buy a car from Carmax. They will take you to HELL and back!!!!!!!

Unfortuneately...

Carmax structures your deals as 2 SEPARATE transactions. You sold them YOUR car and you bought THEIR car this way the deals cant be "undone" at least not easily. You can certainly return their car within 5days but you have sold them you car. I am not doubting the validity of your claim but Carmax wrt financing is usually pretty solid. You may not and likely will not get the best rates but if they say your approved you should walk out of there like I did with a commitment from the lender including ALL documentation and approvals. They dont make contingency approvals.

Go back to Carmax ask them to show you ALL the paperwork including this "declination" letter and try for a reversal of the deal. If the car you traded/sold to them was not PIF then I dont think you have much of an option, sorry to say.

BTW...I dont think being impassioned in the purchase had anything to do here I think there may be some pieces that were overlooked in the approval process of the loan.

Your best solution is to get your old car back, in the same condition it was in when you traded it.

There is a term for this- delivering a car before the financing is completed.... spot delivery? There have been a LOT of complaints here about this practice.

You had better get yourself into gear & protect yourself. They should return your old car if they want to cancel the deal and get the one they sold you back, because if they cancel the deal your old car is again YOUR property. You should visit legal aid for advice.

Next time, follow these rules:
1. Never get excited about buying anything. Purchases should be financial decisions, not emotional decisions.
2. Never leave your trade behind and leave the dealership with the car you are supposedly buying until the deal is complete, i.e. any required financing is solidly in place.
