I received a check from a man in canada. I was to post some ads in a newspaper. He sent me a check and I was to take my first week pay out of it and send the rest a an ad agency.
I thought ok looks like a scam. I will deposit the check and wait and see if it clears into my account. that day CHASE BANK released only $200 which is fine no problem with that. The next day they released the other amount which totaled $2,272.00. I thought great the check is good.
I took $1,900 and purchased the money orders and sent them off. The next day around 2pm I get a text telling me that my account is overdrawn $2,000 the check was fraudulent. they told me that its the law. They have to make the funds available the next business day. IT WAS AN OUT OF STATE CHECK. Government law states that you can hold those checks.
So if your a scammer or con-artist I suggest you bank at CHASE. they will cash your checks.

We went to the courthouse monday. Chase has not responded to the claim against them. Now we put the paperwork to file for default now we have to wait another 10 days.

I will post the upates. your info was helpful. I have problem with me representing the check when I endorse it. Its not my check thats why I bringing it to my bank to see if its cashable? the funds were available the next morning before the check was even processed (we found out later).

- The bank is not your mommy or daddy,. When I cash a check I am fairly sure it is valid. I would be extremely suspicious of a check from someone I don't know, in a foreign country, and asking me to send them back several hundred dollars. You even thought it was a scam, but your greed(and that is what it was) overruled your common sense. Because all you would have had to do is contact the bank and/or company the check was written on to find out it was a bad check.
There is a term that you will most likely hear in court, "Holder in Due Course", So you probably should review that term before you go tomorrow. In the most basic term it basically says that when you present a check to a bank that YOU are representing the check as valid and as such accept responsibility if it is not. This means that if it comes back bad..you owe the money.
But you have several other issues. You seem to think that they MUST hold a check if it is out of state/country..etc. You are talking about Regulation CC the "Expedited Funds Availability Act". That regulation talks about the MAXIMUM time a check can be hold. There is nothing in the regulation that says they must hold it for a MINIMUM amount of time.
You also seem to think that the sender was from Canada that it automatically becomes a "foreign" check, and that is incorrect. The thing that matters is the account it is written on. If you have a copy of the check if you search the Routing Number of the check you will find that it belongs to an account in the US.
You don't say who is suing who, but you are most likely(since courts are unpredictable sometimes) going to be on the loosing end either way. Oh and if you are suing them, if they don't show up and you get a default judgement..don't think it is over. Because when they get the notice of the default judgement it will most likely be overturned eventually if you failed to send the summons to the appropriate address in the beginning.
Regardless of if you prevail or not, I hope you come here and post the results. Also, to post the court information so anyone who wants to can look it up on-line.

I contact the bank they are written on before i put them in my account. So let me guess....you replied to some email with someone asking you to perform an Advance Fee scam. You cash Money Orders and send off to the scammer. Now your caught with your pants down because your the genius that fell for a scam, and now blaming the bank. Ha good luck in court.

Okay, let me rephrase what I said. I am wrong when I said the check was written OUT OF STATE it was from outside the u.s.a. so I think chase bank still screwed up. We will see what the judge says on monday.
