I was looking to get a new plasma televison, and I found this companies website. I took a look, and decided to see about financing. Well, they wanted a huge deposit, which i was not willing to do, so when they contacted me, i told them i wanted to cancel. They charged me a $50 cancellation fee, then a few days later have now hit me with a another $40 dollars! I cannot access the website, and have been trying to get a hold of them, at no success. Now I am going to have to change some account numbers so they will leave me alone! What a joke!

Cancel fee claws are part of the loan contract.

The $39.96 is charged once an application is approved, and are stated in the credit application terms which in order to continue the applicant has to agree with; and state; that he or she has read these terms and agrees with them as well. If otherwise, then your browser will close the application.

The $50.00 cancel fee, is part of a completely separate agreement, which is called the LOAN AGREEMENT or A FINANCE CONTRACT, similar to a car loan finance agreement which is presented after the loan has been approved, including the loan terms and additional details pertaining about the loan that are listed in detail, including any cancellation fees, since at this point the purchase has been almost completed
Furthermore legal loan contract has been signed and submitted to complete the purchase.

Essentially many banks at this point would not even consider a cancellation since the loan contract has been signed. But rather then legally enforcing this in court or other available methods we leave a way out for the consumer for a nominal fee which compared to the legal obligation by the consumer is nothing more then a small partial payment for the time that already has been spent and put in into completing all of the loan paperwork necessary for that purchase by our hard working staff.

In the unlikely event you still think this is unfair and a small nominal fee to recover a small part of our invested expense on a sale that we inevitably are now loosing money on,
Is out of line, then I am truly lost for words, and would like for you to try this at another finance company, to see what the result would be from an identical situation such as the one above.

Inevitably I can safely say, that the minimal fee we charge for completed and agreed to finance agreements, is a complete bargain since you are being released form all legal obligations from a signed loan agreement which now the signer is legally bound and obligated to.

If they have debited your account fraudlently, let your bank know. They will return the charge to you. There is a link for this information in other Circuit Micro threads.

They cannot take money from you for no reason. if they hit you with a cacellation fee, i don't find that in their terms of agreement, only the admin fee of 39 should have been taken
