First, I'm all for a class action suit against Countrywide. My story is similar to Thurman in Temecula, California (2002).

When Countrywide took over my account in 2000 or 2001 from Aurora Loan Services, they never notified me or sent me statements until 3 months later. By then I was getting foreclosure notices. I was forced to file Chapter 13. In addition to that, I was totally caught up on my mortgage with ALS but Countrywide fell the need to take the last payment I sent ALS and apply it to the escrow, again without any notification, there making it seem as though I was 3 months behind on my mortgage. I filed the Chapter 13 and of course got stuck with Countrywide's legal fees.

Well, this year, I was sick and hospitalized in January. My mortgage didn't get paid for December and January until I was discharged from the hospital. I sent December's mortgage the day I was discharged and Countrywide promptly sent it back. They also had went to court while I was hospitalized to get Relief from the Automatic Stay to proceed with foreclosure stating that I had not paid my mortgage in 4 months.

I had cancelled checks up to November 2003 which were ignored by Countrywide's attorneys. I received the notice the day after the court date. The motion was granted and again, I was forced to refile Chapter 13 in March 2004, which Countrywide promptly protested. In May 2004 a Default Order was signed meaning that if I fall 2 months behind on my mortgage, Countrywide can continue with foreclosure without going back to court. And, again, I got stuck with their legal fees all because they have lousy bookkeeping.

To make matters worse, I had a fire at my home last year and now my property is worth considerably more money and Countrywide wants it badly. Since Countrywide has had my account, I have not spoken to anyone employed by them despite the letters, e-mails, and voice mails I had left over the past few years.
