DISH Network manufactures a DTV converter box called the DTV Pal. I purchased one from the online source for their product: SolidSignal (http://www.solidsignal.com), 866-374-4625. The price was $70 total with shipping. The item was purchased brand new and arrived with an operating problem. The video changes between color and black and white at random. The "event timer" feature is so unreliable it is completely useless.

I asked SolidSignal to allow me to exchange it for one which is defect free and they refused. They say it must be returned to the maker which is DISH Network. So, I called Dish Network and they say they will not honor the written warranty on the unit because I do not have a satellite account with their company. The warranty is written in the documentation and clearly states parts and labor are covered for 90 days. Since both the seller and maker refuse to honor the warranty, I have no place to exchange it. I am stuck with this dog.

I believe SolidSignal is violating the law by not honoring the implied warranty of merchantability on the new item they sell as a dealer for the product.

I believe DISH Network is clearly violating the law by refusing to honor a written warranty provided on a new item they make and sell because the buyer does not buy a satellite contract account with them. The warranty is in the manual for the product and covers parts and labor for 90 days. It clearly says:

"This limited warranty is a legal document."

Too bad they don't read their own warranty.

I just want to exchange this item for a new one with no defects, I never asked for a refund. I have called both companies and neither will accept responsibility. However..... a person from DISH Network did call me today to try to sell me one of their satellite plans. They got my number from the complaints I had filed and decided to try to sell me something. I swear..... that's just too funny to make up.
