I hope the information that I have here will help anyone who is dealing with
this similar situation.

My husband received a letter from DCS (Diversified collection service, Inc) stating that he owed the Virginia Department of Taxation back taxes in the amount of $1,430.55. You must understand my husband has not nor has he ever lived in or visited the state of Virginia. I felt that this must be some kind of scam so the first thing I did was call our local police department. The police department told me to contact the Virginia department of taxation, who told me that they needed his SS#, proof of ID and so on (They must have thought we were stupid). I was also told that if he ever stayed in a motel, drove through that state, or had any business dealings within the state then taxes are applied (looks like I will never visit that state). Having the worst feeling about all of this I then contacted the local Department of Justice. The Department of Justice then gave me the # of Consumer Protection Agency. I called the Consumer Protection Agency explained the whole story, and I worried the letter was some kind of scam. I also let them know what I had read off of rip off report, and explained to them that my husband and I were not the only ones going through this ordeal. Consumer Protection agency then gave me the # to the Federal Trade Commission, Department of Justice in Virginia, and California. I was asked to put the word out to everyone: you do have rights and you should contact the Consumer Protection agency. Call the Department of Justice in your state and explain to them your situation, they will then give you the # to the Consumer Protection agency. I really hope that this helps.

Today I have sent a registered letter to DCS instructing them not to make contact with my husband again, I also explained who I have made contact with concerning this issue. (Department of justice in Virginia, Oregon, and California. Consumer Protection agency, and the Federal Trade Commission.)

I was in the state of Virginia 13 years ago for about 6 weeks helping my mother with my stepfathers illness, I needed some money while I was there and I sold some stocks, that were purchased in the state of Nevada. I called the broker in Nevada had them sold in NV. and then had them send the check to me in VA at my mothers. A year later I received a bill from Va. for $1100.00 for state tax on the sale, because of the address, the IRS sent them a copy of the 1099 i rec'd to declare the income on my federal taxes. I called the taxes dept in VA. got a letter from the broker that no transaction took place in VA. and they assured me this was taken care of.


Now 13 years later they say I now owe $3400.00 with penalties and interest, and have sold my account to DCS, I have tried to prove again that no transaction took place in VA. but it has been 13years and I didn't keep the letter from the broker or even the federal tax return.


They have now had my Driver's license suspended in Nevada. I found out today when I got a ticket. I was never notified they even had that authority or that was even a possibility. The debt was still in dispute. I have some other friends from Virginia that have had state taxes due as far back as 20 yrs, that they didn't even know were due. They were given 24hrs to pay it or lose their License in Nevada, how is this even possible to take someones lic. in another state for a debt? This is not a debt I even owe. This must be some kinda scam, but how did they get the authority to suspend Driver's Licenses?

A state entity does not need a collection agency to go after someone that owes them money. Just like the IRS does not need a collection agency to obtain the funds that are owed. Something is definitely wrong with this picture. I hope this works out for you.
