We are in columbus ohio and have been "flipped" from WELLS FARGO MORTGAGE, TO ASC MORTGAGE TO EMC MORTGAGE.

As we read through these forums we are sickened! We have experienced their insurance scamming, added fees, demands of payments through western union, tax games, and every other usureous mortgage rip off invented!
EMC mortgage invents new amounts to psy every day!

EMC MORTGAGE from IRVING TEXAS wanted 1,400dollars Monday September 20, 2006. FINE. We get disconnected during the transfer from them three way to WESTERN UNION which is the only payment EMC MORTGAGE takes.
We call back. CANNOT get the same guy. New guy wants a larger amount.

We get that amount together and cannotget either extention of the first two EMC employees because you must enter your loan number and social on every call.

The NEW EMC MORTGAGE guy now wants first 4,954.94dollars...FINE. I hate your guts and will see if my prosecutor can help me(I have NOT included ALL DETAILS here).

The EMC MORTGAGE guy NOW puts me on hold for well over twenty minutes....WHOOPS....same guy upon noting we ARE going to WESTERN UNION ONLINE his 5k now DEMANDS 7,330.40....he agrees the intrest, principal etc. is LESS THAN 5K but still DEMANDS 7,330.40!
It seems like no matter how much we have EMC mortgage demands MORE!

There are over 300 complaints at the Ohio Attorney General's Office according to one attorney we called.
We cannot refinance, but owe after ELEVEN YEARS under 90k on a house with a minimum market analysis price of 165k.

WHAT CAN WE DO?

HOLY COW!!! What a complete NIGHTMARE that you are going through...I personally don't understand the Forebearance agreements with EMC nor do I understand where they come up with their fees which make it very difficult to figure out what is going on...Have you submitted to them a QUALIFIED WRITTEN REQUEST? That will probably help you in court.

I found a good site that keeps those darn things as simple as possible but, should help you in the long run.

Oh, but we have

This is called a "forebearance agreement"....in sheer frustration we decided to accept the $1500- down in fees and the $300- EXTRA a month (RECALL we have been equity stripped and now, after eleven years of payment about $200- goes to principl and escrow....the other $675- goes to intrest and fees....EXCLUDING the Western Union payment fees....the only method they accept)....anyways after we agreed to pay their extortionate amount, and after one hour on the phone, we got "diconnected" and "locked out" of the guy we had been talking to's extention and voice mail via their telephone triage and the price raised that very day.


They still will NOT refund the grand they took for their special insurance, though we had faxed all info on same insurance we had for 11 years over and over, and so did our agent, by the way.
The principal, intrest, escrowed taxes, late fees came in at just under $5ooo.oo...HOWEVER with their CORPORATE FEES, etc the amount they DEMANDED FOUR DAYS LATER was just under EIGHT THOUSND DOLLARS!



The falsified a "personal service service of the court filing", while we were signed in at a non-profit board meeting with over one half dozen witnesses! The Agent was a courrier service called RAINBOW INC. BTW.


We complained to the clerk, the prosecutor, the judges bailiff, and everyone else we could to NO avail (so far).


We ended up with under 48 hours to file PRO SE, including a COUNTERCLAIM, which we did.
Again a 2 bedroom, one bath on this street has a "market analysis" price of $160,000. We have FOUR bedrooms, TWO full baths, finished basement, fenced yard and garage. We owe under EIGHTY thousand.


So we must wait and see on the judges decision for now.

When on the phone with the customer service people did you ask about fees or a loan history to see why the amount keeps going up? Are you currently in Foreclosure? Are you speaking with customer service or the foreclosure department? Its hard to give specific information to help out when I'm not sure where to go with this one.

So, first get a loan history and call EMC back and make them run down every fee and why it was charged etc...Second, if you are in foreclosure you can ask to be placed in workout...Now that's a totally different department but that will keep you from losing your home...Third, and worse case you can file bankruptcy if need be...Best to check with a lawyer before hand though.

Right now I would get a loan history and see what's going on and go from there...See why the amount keeps changing.. Surely someone can explain it.
