I paid for a preorder on a Chapparral 2J car probably 6 or more years ago. It never materialized and every time I contacted the company to follow up it was always the same story, some version of "I just saw the proto type. It's going to be out at the and of the year."

When I called a month ago I was fed the same storyonce again almost verbatim by the guy at customer support. This time when I  said I wanted to cancel the order which was met with "Oh, i just saw the proto-type in Dubai! It's going to be out at the end of the year and sell for $1200! You'll be missing out!" I stuck to my guns and insisted I wanted my money back and had no interest in the car.

He relented and said he had cancelled my order. i told him this had been paid so long ago I knew i no longer had the credit card I used and wasn't even sure which bank it was from. He said it was no problem and assured me accounting would call me withing 48 hours. A week went by and nothing. I called back. "You'll hear something within 24 hours." Another week with nothing. Another call "I will look into it. You'll get an email." My email had changed to so I gave him my new email but it was obvious to me he didn't enter or write anything because he responded so quickly and disinterestedly. Of course, nothing happened. I never received any acknowledgement my order was cancelled, either. MNy phone number and mailing address have been the same for almost 40 years so it isn't like they couldn't contact me if they chose to.

Before I came here I tried the number and was disconnected after the menu and every time I tried to call back it was busy.  I know what they did by keeping my money so long without producung a product for it is 100% illegal on both Federal and local levels.

Still, they blow me off and I really doubt I am going to get my money back without escalating this. It strikes me the speil I got had been performed so many times it just rolled off the tounge of the guy I spoke to. He struck me as the consummate con artist although eXoto do sell quality stuff. No compalint there.  It's just I'm a 60 year old man and I can't get anything out of this experience with them that they are trying to cheat me with this.

Before coming here I tried to call the corporate office number again and got disconnected immediately after the menu which was followed by busy signals every time I tried to call back over the next half hour. I expect zero help from them and I think the only way I will get my money back will be by filing a complaint with our state AG office. I also plan to report this to the BBB as a warning to others who make the preorder mistake.

This may also be fodder for local news since beside being a senior, I am a disabled veteran. I know this won't be over on my end until I have my money back, possibly with interest since what they did was illegal.

Dear Jimmy,

Our SALES CONDITIONS clearly mention no CASH REFUNDS. In your case, we made an exception by refunding your money. We were not legally required to do so, but we did it because you have been a good customer through the years, and your refund was a very small amount of money. It was no worth prolongating over.

Jimmy Z. has been a valuable EXOTO customer. As with all EXOTO collectors, he was always satisified with the product and services we provided.

The implosion of the die-cast manufacturing base in China has pushed high-end modeling by decade long delays. This was a "force majeure" situation as China was quickly moving to become an economical super power. So, the landscape in our industry has changed, and collectors need to be much more patient before receiving new products. For this reason, Exoto Inc. has also stopped taking deposites on over 80% of our new releases.

Per our Sales Conditions, clearly mentioned in our website and sales materials, deposits are non-refundable (NO CASH REFUNDS). This said, our customers are always given the choice to choose an alternative collectible, a series they also collect, for us to adjust against their deposit. Therefore, deposited funds are always refundable but not in cash form.

Many times in such cases, consumers complaining stop short on telling the complete story, or once an issue is resolved, they fail to come back and complete their complaint.

Since I do not have a FULL NAME or CUSTOMER NUMBER, I cannot comment at this time if the issue of Jimmy Z. has been resolved. If not, Mr. Jimmy Z., please contact me directly so that we can conclude your deposit issue.

what a battle but I finally got my refund

I filed a complaint with Indiana State Attorney General's office in late April/early May 2014. Exoto refused to respond to the complaint which to my chagrin was a mediaiton, not a threat of lawsuit as I had hoped. It turns out that in Indiana there is a 2 year time limit on non-delivery of goods and services during which it's actionable. After that it goes to mediation for a settlement but as Exoto proved, there is no legal requirement to respond. Their "it's coming out this fall" speil made it easy for them to dupe me into exceeding the 2 year cap. It also explains why the other guy, not that Shane Meyer who is the head liar and con-artist, laughed when I told him I was filing a complaint with the Indiana State AG office. he knew there was nothing Indiana could do.

At the recommendation of our state AG's office I also filed a complaint with the California State AG's Office which I did on-line. That was in early June, 2014. About 10 days later I received notice form them had had contacted Exoto with my complaint. Less than a week later I had a refund check paid in full. In true con-artist fashion the check was back-dated to June 3 but the postmark on the envelope was June 17th and I received the4 check on the 20th.

California has a real no BS consumer protection division and part of what they replied to me was that my complaint was being kept on file and that combined with exisiting and future complaints against Exoto could result in a lawsuit against6 them replete with penalties.

I strongly encourage everybody who has an issue with Exoto file a complaint with the California Attorney General Cunsumer Protection Division. The form can be filled out on line and took me about 10 minutes including edits. It is incredibly simple and I didn't have to attach receipts and other documentation in the initial stage. I assume that may be required in escalations but apparently they have enough clout that even Exoto backed down and tried the back dated check ploy to try to cover their con-job way of doing business. I have reported that little trick and copied both the check and envelope forwarding it to California. Of course, the check is still clearing...

I would recommend if Exoto is screwing you around on anything, don't waste your time giving them more than a couple chances to make it right. File a complaint with the California AG office. If enough of us do it a suit will be brought against them and they certainly deserve it!
