I bought a new "Magnum 300" from a man called "Don" from Family Motorsports for $4,000 plus $99.00 for an additional year of warrantee on the engine. The trike was to be delivered to my home. A frieght company, here in Corpus Christi, could not deliver the vehicle because they did not have a lift large enough for the crate. I found someone and paid them for the delivery.



After assembling the back fender, windshield and luggage carrier and charging the battery, I put oil in the trike along with high grade gasoline. The vibration in the front end was excessive. A day later I had to charge the battery again because it was dead. I took the Trike to the authorized dealership (Cycle-Plaza) to find out why the the battery died. The mechanics did a battery test and told me a couple of the cells were bad, I ended up buying another battery for $89.00 plus tax.



Two days later this battery would not give me enough power to start the trike. I then took it to a motorcycle shop near my home "Cycle Imports". Mario the owner spent over an hour checking and rechecking the system to see what was causing the battery to not charge. He said it could be the regulator or the stator. We called the company and had another regulator sent out. After exhaustive checking the trike out it did not solve the problem. A stator was requested but it took numerous phone calls and 3-1/2 weeks to receive it. Mario installed the new stator and that solved the problem. But, while the trike was on jacks we found that the right hand rear tire went back and forth- It seemed to be missing a bushing or bearing. Then we found that the air filter was not connected or supported in anyway and we also found a stray wire that seems to go nowhere. I have had the Trike since March 14, 2011 and have ony 310 mies on it because it is a lemon. The below is their reponse of my constant emails and phone calls:

I spoke with Management and the Manufacturer many times concerning your claims, here are the results



1) According to the Refund policy we cannot issue a refund, the refund policy is below;



RETURN/REFUND POLICY:



We offer a 100% MONEY BACK GUARANTEE for your vehicle, please notify us in writing within 2 days of receiving your vehicle, and we will issue you a full refund for the vehicle. Please allow up to 7 business days for us to process a refund after we receive the returned vehicle. A 6% merchant fee will be

deducted from your refund if you paid with a credit card or an instant transfer via Paypal. All items are brand new sealed in manufacturer's packaging, there are absolutely no refunds or returns/exchanges allowed for any items that are assembled, used or fueled for any reason as the vehicle would be considered used.



2) You state that there is a bushing missing in the rear right tire, I spoke with the Technician at the Manufacturer and there are NO bushings in any of the rearwheels at all and have no idea what it is that you are claiming to be missing.



3)When it comes to vibration in front of the bike, the only known cause for the vibration could be 1 of 2 reasons, insufficient air in the tire, or the front wheel needs balanced. BOTH of which is not a warranty item but OWNERS responsibility.



4) As far as an unknown wire, we have no idea what wire it is your referring to, unless we have detailed pictures of it, we cannot determine where it goes or if it is suppose to go anywhere.



5) According to the Manufacturer and our experience, the replacement of both parts that were sent would take a novice person a maximum of 1 hour to install with little to no mechanical experience, it should take an experienced Mechanic no more than 30 minutes to replace those parts. Your Mechanic stated it took him 21/2 hours to complete the work which tells us that your mechanic is inflating

the bill. We also do not pay for oil changes.



6)According to the Warranty Policy, we sent replacement parts to you free of charge, we went above and beyond the Policy as we DO NOT ship parts to customers Overnight shipping unless the customer is willing to pay for the

shipping. We sent parts parts overnight and paid the $50.00 to do it and did not charge you for it. Our Policy states that we ship parts our  BASIC GROUND SHIPPING



I have contacted the company on two dozen times with no call backs. I have spent a total of $369.00 in labor charges and they are coming back with an email that states that any novice could have repaired this trike in a little less then an hour and therfore would not reimburse me more than $40.00.



Because of the lemon law in Texas and because the trike was NOT in riding condition when I received it, I have asked for either a complete refund or a new trike, neither have been given. I have in my possession all emails and receipts on this transaction.

It is very unfortunate that you are having so many problems with your trike. However, the things that you are requesting Family Motorsports to replace are not covered under our warranty. I would encourage you to review our warranty information on our website again. Also we only cover labor under warranty if the issue has to do with something inside of the engine. Or if our trained technician who specializes in working on our products and offers life time technical support to our customers cannot for some reason diagnose a problem over the phone. Any labor beyond that is the owners responsibility. All of these conditions were signed by you before the purchase of the trike.

Since you stated that you have 310 miles on the vehicle you have obviously had some opportunity to ride the trike. Which leads Family Motorsports to believe that when the vehicle was delivered it was able to be driven, therefore disproving you accusation of Family Motorsports selling items that don't start right out of the gate.

The man that you bought the trike from is not in any way affiliated with Family Motorsports. He is a man who owns his own company called Free Spirit Motorsports, and we shared a office building with him in Pennsylvania. For a period of time, he was stealing our sales and keeping the profit for him and his company while letting customers believe that they were purchasing items from Family Motorsports. When this was discovered Family Motorsports cut all ties with this man and to protect our name, serviced the customers he sold these items to under our name. I strongly encourage you to check your bank statement to further investigate who your money went to because I personally, am willing to bet that it wasn't Family Motorsports.

Regardless of who the money went to, whether is was us or it was Free Spirit Motorsports, we clearly have gone above and beyond what our warranty covers by over-nighting you parts and working extensively with you to resolve the issue. As you clearly show in your post we offered you a refund for the bike assuming that it was still in brand new condition minus the 6% fee that you signed and agreed to before the trike was sent to you. Because it was not in this condition we could not issue the refund.

As far as the trucking company not providing lift gate service that is something totally out of our control seeing as we outsource trucking to deliver the items we sell. We pay for the lift gate service and shipping and that is the extent of our involvement in the shipping process.

Again, we are sorry for your troubles. I assure you that we do our very best to service and assist our customers within reason. I know this both on a personal level and a professional level. We as employees have polices and procedures that we must follow which we have and we have made every effort to resolve the issue in this matter. Please feel free to contact us again, maybe something was misunderstood on either of our parts. In any case we would love to help as much as we can within reason.

What kind of frickin idiot with no mechanical ability orders a piece of crap Chinese scooter on the internet and expects it to be like a Honda Civic? If you were not stupid and either broke or just plain cheap, you would have gone to a dealership and paid for a good brand name product. You have nobody to blame but yourself for what happened to you. You wanted cheap, you paid for cheap, and you got cheap. Surprise, cheap don't work.
