I also was taken to court by these people.  I'm trying to pay off all my debts by working with a debt consoltation company who talk directly with the companys to bring down the debt and start making payments to pay it off.  
 My debt was with J C Penny's.  I received the papers without any warning or mail sent to me.  The debt consoltation company had sent them papers and never received any response.  I of course didn't want to go to court, which I believe they were counting on.  I contacted them and made a agreement to make a very high payment every month.
 I became unemployed in January 2011 and contacted them as soon as I could to let them know and to arrange a lower payment that I would be able to make.  They refused and ajustment and said that I had agreed to these terms and they didn't care.  They even said that I should be paying more.  Now in only getting $1000 in unemployment, the payment they wanted was $210.  I'm still only working part time and this payment is killing me, but I don't want to go to court and I don't know what my other options could be at this time.  Yes, my husband is working, but he's paying for all the household bills and mortgage payments.  
 So whats a person to do?
