In JANUARY OF 2008 I RECIEVED A LETTER STATING I NEEDED TO GET INSURANCE ON MY VEHICLE. ABOUT A FEW WEEKS LATER AFTER GETTING THE LETTER I RECIEVED A NEW PAYMENT BOOK. MY CAR NOTE HAD INCREASED FROM 355.10 TO 631. AS YOU KNOW I WAS DISGUSTED AND HAD TO CALL THEM IMMEDIATELY. WHEN TALKING TO A REP SHE TOLD ME THAT THEY ADDED THEIR OWN INSURANCE THAT WAS ONLY GAP AND WHEN I GET MY OWN INS. MY PAYMENT WOULD GO BACK TO NORMAL. WELL I GOT THE INSURANCE AND FAXED THEM A COPY AS WELL AS THE INSURANCE COMPANY DID, TOO. I ASKED TO SPEAK WITH THE INSURANCE DEPT WITH FIFTH THIRD BANK TO LET THEM KNOW I GOT MY INSURANCE AND WHEN WOULD MY PAYMENT GO BACK DOWN. WELL I WAS TOLD THAT MY PAYMENT WOULD BE 631 UNTIL SEPTEMBER 08. HERE I GO SPEECHLESS AGAIN. I WAS INFORMED THAT I HAD TO PAY FOR THEIR INSURANCE FROM SEPT 07 TO SEPT 08. I WAS HIGHLY UPSET BUT I CONTINUED TO PAY THE NOTE UNTIL APRIL.

AFTER THEN I RECIEVED ANOTHER PAYMENT BOOK AND THE PAYMENT DECREASED TO 522, THAT WAS STILL STEEP TO BE PAYING ON AN IMPALA. SO I DECIDED TO STOP PAYING. I RECIEVED A CALL FROM THE COLLECTION AGENCY STATING THAT I WAS BEHIND TWO MONTHS AND WAS ABOUT TO GET REPO. WELL I SET UP PAYMENT ARRANGEMENTS ON WEDNESDAY TO BE TAKEN OUT ON THE FOLLOWING MONDAY. WELL ON THURSDAY I RECIEVED A CALL AGAIN FROM THE COLLECTION AGENCY SAYING IF I COULDN'T MAKE THE PAYMENT THAT DAY IT WAS GOING TO GET REPO. I INFORMED THEM THAT THEY COULD COME AND GET IT. THE REPS AT REGIONAL ADJUSTMENT BUREAU GOT REAL FIESTY, E.G. SAYING YOU SHOULD HAVE PAID YOUR NOTE ON TIME AND ETC.

TODAY IS FRIDAY AFTER THAT MONDAY AND MY CAR IS GONE - REPOED WITH ALL OF MY BELONGINGS (PURSE, GROCERIES, WORK CHECK, AND OTHER IMPORTANT INFORMATION). I CALLED THEM TO FIND OUT THE REPO COMPANY NUMBER TO GET THE BELONGINGS OUT, I WAS TOLD THEY COULDN'T DISCLOSE OF THAT INFORMATION WITHOUT A POWER OF ATTORNEY. NOW I AM CARLESS AND PENNILESS. ; /

I have kinda been having the same problem except I have insurace. They tell me to fax them the papers and they will take it off and for a year now they still have not taken the added insurace they put on. So then one day I get out of work and my car is gone amazing. They came and took it.. Then I had to pay to get it back. And on top of all this crap When i got the car my dad co signed and they put him as the main holder. Well needless to say my dad had perfect credit until this happenned.

Not a RipOff...

There is not really any RipOff here, as you did this to yourself.

Not only was it in your loan documents that you are required to carry insurance. Most states have laws that make it illegal to NOT carry insurance. If you had happened to have been pulled over there is a good chance they not only would have towed your car but suspended your license, with some hefty fines.

From what you have written it seems as if you were without insurance from at least September 2007 up until Sept 2008. They only started charging you insurance sometime in January. So you were paying a higher amount not only for the current insurance, but to make up for the time where they were not charging you at all.

When YOU decided to stop paying YOU got yourself into a big problem. You told them to "come and get it", yet you left everything in your car? When did they take the car? Was it the second you stepped out of the car...Probably not. Most likey they took it either in the middle of the night or when you were at work. Both of those times makes it very unlikey that you would have your purse and grocieries in the car. Not only that but most people don't just leave their paycheck lying around they deposit it.

Just fair warning that if they sell your vehicle they will sell it for about 1/2 of its actual value. You are still going to be responsible for the remaining loan balance, in addition to the any repo or court fees that were also involved.

Why go without insurance?

Why in the world would you go without car insurance in this day and age? What if you should get into an accident and it was your fault? You could be sued and jailed.I know that car insurance is not cheap.But going to jail or being sued is not good either.I would not drive any car new or old with out some sort of insurance and not paying for the car too was not right.There is no rip off either here. The bank has the right to recoup their money .Does 2 wrongs make a right? And leaving personal items in a car with so much theft going on is another bad idea.It sounds like to me that you have been very careless about your money there and now blaming it on the bank.

It's gonna get WORSE for you.

You're gonna get hit for the repo fee.

When they sell the car, if they get less than the outstanding balance of your loan you're gonna get hit with the difference.

YOU breach your loan contract by NOT keeping the required insurance in force.

Then you get INDIGNANT and stop paying, so naturally the repo the collateral.

Now you claim you're ripped off.

As to needing a POA-who is the registered owner of the car? I can't think of any reason you would need a POA to learn where the car is and reclaim personal property UNLESS you are not the registered owner of the vehicle-in other words, you're not on the title.

Being without a car and broke is tough, but I am having trouble seeing how you were ripped off.

You presumably went without insurance on your car. Why would you do that? Especially when it's a car that you owe on.

The rest of the argument ends with these words from you:

"SO I DECIDED TO STOP PAYING."

Why, especially since you knew there was a chance that your car would be repord, di you leave your purse, groceries, work check and important papers in yhour car? Your car is NOT a bank or a storage facility. Don't leave anything in your car you can not afford to loose. And it si RECEIVED not recieved.
