Fifth Third Bank was served a subpoena by the Lake County Sheriff Department in November 2007 to provide information to the personal representative of an estate on a decedent there. A Fifth Third Bank branch employee informed the Probate Commissioner that the Branch couldn't provide the information because the custodian of record for the bank was their legal department.

Subsequently, on December 13, 2007 and January 22, 2008 the Legal Department after reviewing the request for information pursuant to Indiana Code 29-1-13-1.1, electronically stored documents of deceased, refused to send the information to the personal representative of the estate of the decedent violating the sovereignty of the State of Indiana by ignoring it's laws and it's courts. The legal department stated that they could not do that because they employed the blame game, that is the branch stated that the corporate office was the custodian of record for the accounts and the corporate office stated that the branch was the custodian of record for the accounts. How dumb does this bank think the American Consumer is?

The reason for the investigation into the accounts have been depleted amounts have been taken from the decedent accounts by Bank employees having been subject of a con. In order to conceal the con the bank has falsified records to conceal the theft of funds from bank accounts of the decedent.

Fifth Third Bank is deceiving the public by representing that the integrity of bank accounts isn't a problem, however that of the decedent in this report have been tampered with for personal gain. It should be important to each reader that it will cost the estate money to force this bank to deal fairly with it account holders. How safe are your assets if you bank with Fifth Third?
