I currently owe about 1,350.00 in medical bills. Franklin Collection Services ended up buying my account. They would call repeatedly. Day & Night. I answered the phone when they called me in December of 2008. They told me the amount that I owe, and I told them I am in a bad financial situation and can only afford to pay 20 a month at this time. They said it was not sufficient, and wanted over 300 a month. I simply could not afford that amount. They asked me where I worked and wanted my banking information. I told them where I worked at and that was it. They are how many people were garnishing me at the moment, and no one was. They then told me that if I didn't call them back by the end of that particular business day with more money to offer then they would file a judgment against my on that day. They insisted that there was someone or some way to get them the type of money that they wanted. I kept telling them that they weren't working with me, and I was crying and truly scared of getting sued. I hung up with them, then called them back by the end of the business day. I agreed to pay 150 a month, and asked them to call me in March regarding the rest of the account. I make 260 a week at this point in time, and making those payments and providing for my child was hard, but I tried to manage.

In March, my financial situation changed for the worst. I had to step down to part time, due to my autistic child. I went from 260 a week, to 150-175 a week. I called Franklin Collection Services and told them I could no longer afford to pay them since my situation has changed. They threatened to sue me and garnish me again. I explained that I went down to making 450-500 a month. They insisted that I get child support, (I don't.), or have other means to pay them. She was extremely loud on the phone asking how I pay my other bills, and so forth. She asked me who supported me, and at that point in time I was so tired of being interrogated I said, and how is that any of your business? She then said, that's what I thought! We got you on a recording saying you will pay and you will pay this bill. She said they would draft at the end of the month and the funds "better be there." I am so tired of being threatened. From my understanding it's against the law for a collection agency to threaten you in this type of manner.

You Do Have Rights!

As a nationwide Judgment Enforcer I know the laws regarding Collection Agents. I have read your complaint, and you do have rights! I will state what you can do, and what Collection Agents can't do.

What you can do:

1) Stop giving them information. Tell them you are hereby notifying them to stop contacting you at home or work. Do this by a 'Signature Required letter' also state this on the next phone call from them. (Fedex/UPS).

2) Contact the FTC and file a Collection Abuse Complaint. (WWW.FTC.com)

3) It is your right to contact the original billing agent (Hospital/Doctor/Medical Facility). In most cases they will work with you, and stop the collection process.

4) You can contact me at my website (WWW.BLJudgmentEnforcement.com) you will find all my contact info there.

5) DO NOT give them ANY personal info (SSN, Banking, Work, Financial Aid, etc.).

What they can't do:

1) They are not allowed to threaten you in any form.

2) They can not call you at work unless you grant them permission.

3) They can not call you between 9pm - 9am.

4) They can NOT garnish your wages, place liens on bank accounts, or personal property (that's my job). This can ONLY be done after a court judgment is held against you. The only way this can happen is when you are legally notified to appear in court on a specified date and time (usually done by subpoena). This case will usually take place in small claims court if under $5,000.00.

Stick to your guns and don't let them bully you with fancy legal terms, court actions, or attorney's. If this was to go to court it is my experience that this case would be tossed out do to hardship, or the judge would ask you for a payment plan.
