So I re-financed my auto loan with HSBC back in March of this year. Everything was going fine until about 2 months ago. All the sudden I start getting those annoying outbound calls to all my numbers I had listed on my account. So I finally talk to someone (an outbound only call center not even in the US) and they tell me that I'm 17 days past due on my payments. I tell them this is not possible as I just made my monthly payment a few weeks ago.

After a lot of digging with them on the phone and comparing of my notes, and several annoying calls back to me every day we determine that the first payment I made on the account back in April does not show up in their system. Funny as it had up until the month of June as I had not received any calls regarding my 'Past Due Account' until then.

So I fax them a copy of my April bank statement to their 'Clerical Department' and circled the payment. It was done electronically through THEIR system. The calls stop for about 3 days and then they start again, same thing, you are behind on your account.

They look it up and show that they DID get my fax, but now the Clerical department wants to know the ACH routing trace number from my bank. So I go back to my bank and get this information and call them back with it. They tell me it will be about 72 hours and it should all be handled.

Then guess what, that's right, the calls start again, you are behind on your account. I tell the story and this time get a manager (whatever). They tell me they are going to send a note back to the Clerical department again and they will hold the calls for 72 hours. This happens 7 times in a row. Each time me explaining and them giving me the same speech over and over.

Finally after a month of this going back and forth they tell me the Clerical department needs a copy of a 'Running Bank Statement' from my bank. I don't think this is necessary, but I provide it anyway. I fax them bank data running from March to July. I also circled EACH and EVERY payment I had made to them, all of them being electronic payments made through their system.

So I start getting the calls again. They tell me I should call customer care and speak to someone else. So I get the number and now 3 different days I have tried to call them and I finally get to the prompt for a customer service rep and I'm on hold for about 60-70 seconds and it comes back and says they cannot complete my call at this time and it hangs up on me. I need some help here. Can I take legal action against them? I'm so sick and tired of the calls and explaining my situation, especially since I have been making my payments. I checked and it does not look like they have reported anything negative yet on my credit report, but who knows.
