Huston & Sons Trucking Broken Contractual Agreements and Held freight Hostage Coram New York

We contracted with Huston Trucking to pickup this partial load of freight on 3/22 in Miami, Fl and to deliver no later than 4/26 in Brooklyn, NY.

The terms per the rate confirmation were that upon delivery the $900 would be paid within 24 hrs after deliver. After pickup of the freight by Huston Trucking, we were alerted to a change needing made based on a prior conversation, and that $600 was needing to be wired prior to delivery. This is outside of the terms and agreements in place but we agreed to this because this is a good customer and we wanted to help the driver to ensure a smooth transit and on time delivery.

That day at 3:30 pm pst we made a wire transfer from our bank for $600 (plus wire fee) so the freight would deliver on time come Tuesday. The wire didnt go out until the following Monday 4/25 at 8:54am pst. The wire has been confirmed as sent from our bank at 8:54 am on Monday 3/25. Huston Trucking does not acknowledge this and instead have chosen to hold the freight hostage and charge $500 a day... until total payment is received in the amount of $900 outside of our contractual agreement. They are holding this freight hostage. We have repeatedly tried to contact Huston Trucking to get this delivered by any means necessary, but they wont answer any of our calls. In an effort to simply get this freight delivered we have authorized the customer to pay the driver upon delivery where we will then credit his card for the full amount... leaving us with the fees of the wire transfer, credit card fees, etc in an attempt to somehow salvage the harm caused to us and our customer by Huston Trucking. This has resulted in irreparable harm to us and our customer.

This is so far beyond the scope of the contractual agreements we had in place with Huston trucking and they have repeatedly broken said agreements every step along the way. If you value your relationship with your customer I STRONGLY ADVISE NOT DOING BUSINESS WITH HUSTON TRUCKING.
