I recently applied for a payday loan online. (Last chance payday loans) On the website in the top left corner of the page is a red box that states the id theft recovery service is optional. I never clicked on anything to approve or decline the service and have been charged $31.98 for their service. They have stated it was user error and declined a refund. The word optional means I should be able to decline the service. This is theft by decption correct?
