In this fraud case :

I am even more shocked by Bank of America’s reversal of decision. They prefer to give the money to someone who they know has no rights to it, than to the account holder. But "they’re really sorry". At least something that would never happen in EU, banks (try to) help their customers, not ppl who steal from them and boast about it. I tried everything, lawyers, police etc.. but they would rather be sued by their client than not accommodate a fraudster. 

 

The lesson is : If you need money, just get on a “signature card” of some company fraudulently, steal up to 100K$ bc that’ll cost the company more to retrieve the money; and voilà!

Obviously the decision the Bank made is extremely disappointing and raises various concerns on the lack of security of funds in general - if anyone with obvious malicious and stated intent chooses to abuse a right which is in itself hardly understandable, that is wiring company’s funds to his own personal account by stealing a debit card. 

I eventually managed to have the initial decision and the one which was rescinded - despite Polites not being a signer on the account at that time, on July 3rd - sent to our address, not Polites’. 

These will be added to the Prosecution files against him. 

Would you please give me the contact of your Legal department: Polites was able to have his father-in-law, who may or not be an “attorney", speak to them, so I would appreciate the same privilege as the account holder.

On my end I also did all I could and was on the phone every single day, sent dozens of emails, signaled the transfer within the hour and long before it was even processed - this is a grave matter as besides my having to refund the company, this undermines my credibility as its CEO and comes at the worst timing of a round of investment. Prejudice would go way beyond monetary loss.  

 

In any case Polites managed to eventually have the wire approved bc as of today he is still a signer on the savings account. Fraud and Customer Service did mention you should check with them that they do have the updated card: 

To conclude this needs to be fixed ASAP, and the bank should recall the transfer bc he should no longer have been a signer on July 3rd. 

 

I understand this kind of mishap can happen, he basically pushed every day, and at some point despite the freeze and the fraud warnings and resolution of the fraud case on July 2nd, he still managed to withdraw funds online (not in person)

But there are clear grounds for the transfer to be recalled and I’d appreciate you did what is needed for that. 

Polites confessed to his wrongdoing to about 20 people and the signature card is not meant to be ostensibly abused as a tool to facilitate the actions of a self-proclaimed con artist. I am the President and CEO of Acme, Corp while he never even had an operational role in the structure - 

 

and again there are surely cases where a partner gets fired and should not be able to run to the nearest bank and empty the company’s account onto his personal account. This could not happen in Europe but I am sure that in the US banks are also looking to protect their customers, and we know there is a latency period for the wire to be processed. So if I signaled it within the hour and it was stopped, if I proved he was unauthorized to perform it, he may have played a customer rep a week later. 

 

He still won’t be able to produce a single document authorizing him to do so: an error on the update of the sign card can happen, and banks are able to recall transfers when the account owner demands it in the shortest possible timeframe. 

 

Pls let me know if you need updated legal documents (police reports, prosecution memo, attorney’s briefs etc). Thanks so much for finally resolving this…

I sent up the signature to scanning as soon as I received the second clear copy back from you, I am looking at the faxed confirmation right now from July 3rd. As you know I have gone over and above to work with you, I.E. sent you signature cards and wrote back to as quickly as possible when the copies you sent me were totally blurry. I have the confirmation for the savings account being faxed up on July 3rd. I just left Desmond a voicemail as I’m not sure what is needed at this point, I certainly can show him the confirmation of the fax to the signature card area. He has left for the day it appears. Thx, hoping the analyst will end up getting back to me. But he sent confirmation that no wire had been processed on July 2nd. 

 

The issue is that they confirm that the signature card has NOT been updated on the savings account, which you told me you did? 

 

this is why Polites was able to actually process his wire on the 3rd of July.. and keeps changing the Primary address 

 

counting on you to rectify the mistake and re-credit the wire ASAP. 

They tell me you need to call in the call center to ensure that they can’t see the old signature card. 

 

I obviously canceled the debit card which Polites stole and used to add his account. 

 

Thanks for your help here, the fraud is abundantly clear and claimed by Polites and I understand that this mishap can happen, but I would appreciate it being settled once and for all.

I assume some kind of mistake was made by someone who was pressured (see Polites email below). 

 

However I believe there are strong grounds for Bank of America to recall that transfer. 

First, could you confirm that Polites is entirely off the account? 

I don’t understand why he can still change address etc - I don’t know, since the freeze does not seem enough, if we should keep the funds where they are, and if further risks are to be expected. 

 

June 26: Polites is removed from a project unrelated to Acme. I confirm to him around midnight CET. He never had any operational role with Acme- as I explained to you, I (wrongly) believed that if something happened to me, it would be wise to have another person in the US to deal w the funds. 

June 27: around 3AM EST, Polites who had planned retaliation, and had stolen my debit card, adds his personal account as beneficiary. 

Proceeds to wires online with stolen codes and stolen debit card (I never gave him web access). I get alerted, call right way to freeze account, send you all documentation to have me as only signer on account. 

A fraud claim is filed and I’m told the wires have NOT been processed and I stopped them in time. 

July 1: by then, I understood I am he only signer. Originals have been mailed. 

July 2 : after many exchanges with fraud, Fraud Analyst “Desmond Taylor” at 972 889 7915 confirms he “closes the claim and no loss was incurred since no transfer happened.” Confirms he will send letter to our address 

July 3: I notice that Polites changed the address back to a place where he can receive the funds. 

July 6 : I notice that a wire is eventually processed to Polites, who confirms he has been pressuring the bank to perform it. As sole account owner, I do not get any notification of a transaction signaled as fraudulent a week before. 

I am not looking for BoA to admit to any wrongdoing, but to stand by its decision to acknowledge the conditions of the transfer were fraudulent and malicious, and to revert it. 

Thank you for letting me know if you can help, and more importantly, if the account is secured as of today or not.

I told you my father in law was an influential lawyer, so when I advised you to drop it, you shouldn’t have wasted your time. I was gonna get my way with Bank of America no matter what, everything was planned well in advance. 

That’s the price you have to pay, and I couldn’t care less about who this puts in trouble. I have investigated long enough to make sure you could not do anything in practice. 

For once, you lost - and I advise you to stop wasting your time. 

I don’t care about my reputation, I will resume a government job shortly and they won’t be checking Google.
