I took out a loan from Boatman's Bank to pay off an American Express credit card that my husband ran up.  A couple of months after I took out that loan Nation's Bank bought out Boatman's Bank.  I continued making my payments.  I made most of my payments in cash when I got paid as that was the bank I used for my checking account and I did all of my business at the same branch.  Not long after Nation's Bank bought Boatman's Bank, Bank of America announced they were buying Nation's Bank. 

I did not lilke Bank of America and refused to do business with them and it was around tax time and I had my refund and I used it to pay off the loan at Nation's Bank.  I was given the paperwork and I put it in a green lock box when I arrived home.  I didn't think anymore about it.  Several months went by and my husband and I separated and later divorced.  He took that box with him with the papers in it.  I know that it was at least a year or two later before Bank of America started pestering me about owing them money.  I said I don't owe you anything.  I don't have an account with you.  They said it was a credit card and that it was an old account.  I told them I didn't have a credit card account with them old or otherwise.  They weren't sure what kind of account it was and then they said it was when they were Nation's Bank.  They asked if I had an account with Nation's Bank.  I told them I paid off a loan from Boatman's Bank when it was Nation's Bank.  They said they didn't show that.  They showed that I had an open account from Nation's Bank.   This account has been paid in full once by my income tax refund and secondly by a chapter 13 bankruptcy.  Now I have a judgement by Bank of America that is being collected by John R. Cheadle, Jr.  $11,757.00 on a loan that was for less than $3000.00. 

I am sick and tired of paying for something I don't owe.  I have to pay him $100.00 per month for the rest of my life.  To beat that now he has taken out a garnishment on my wages and is still collecting the $100.00 from my bank account.  I do believe that is illegal Mr. Cheadle.  You can't have it both ways  you crook.  One or the other not both.  Since you are getting the $100.00 per month you have to stop the garnishment.   This man and Bank of America loves ruining people's credit.  What are you supposed to do?  I don't have the money for a lawyer to fight back.  I have been paying that judgement for three years.  I think Bank of America has received enough money that doesn't belong to them.  I don't owe them anything already.  It is time for this to stop.

Get your story to all of the Investigative Reporters at all of your Local T.V. Stations in your city immediately.

Maybe one of them will help you out and do a story on T.V., right?  If it's happening to you, it's a safe bet that it's happening to others, wouldn't you agree? Expose your story and send a copy of your Ripoff Report to all of the Local T.V. Stations in your city with a contact number and your email address.

What did you use to pay off the loan?

Do you still have any canceled checks or bank statements showing the payment? If not, do you remember or have enough account info to have a copy of the check drawn up from that bank? How did the judgment get issued? Were you informed about the suit before the judgment was issued? Can you not locate your ex to have him forced to cough up the papers? Do any of your local TV stations have an action reporter who takes on such cases? Maybe the local law school has students who would work on this pro bono, or for a minimal amount. H**l, you have nothing to lose by contacting some bigger law firms and seeing if one of them might not help you out pro bono, or again, for a minimal contingency fee.

My divorce papers say that we cannot create new debt in each others name.  As far as debt created while we were married, all of that debt became mine because I received all of the assets and the children and all of the debts.  My ex skipped town with all of the money.  He was supposed to pay alimony and child support but I guess he decided he didn't want to because it was like pulling teeth getting it out of him.  He still owes me $30,000 plus interest.  I can't get the courts to help me out with that, but they don't mind making me pay a loan that has been paid two times over now plus interest at an astronomical rate.  Where is the justice? He hasn't even filed his income tax returns since we have been separated.  How is he getting away with all of this?  Why am I being picked on for something that I paid off a long time ago?  This is not fair?

Bank of America or any bank/loan company, is required to provide you proof of payment record and amount owed.

What are the laws about marital debt in your state and do your divorce papers address marital debt?

In my state your husband, without the divorce saying you are both responsible for your own bills,  he is half responsible for the loan and it would cost him less to give you the papers from the box.
