Dear rip-off report, In April of 2000 I was a defendant in a civil suit # SCW 2000-33. Judgement was rewarded to Richard Dan, dba Kamaaina Loan in the amount of $373.00 which was garnished from my two of my paychecks.On 9/26/2005, I went to a company to get a loan. my loan was denied due to a report made by Kamaaina Loan on 7/12/2000.I called Richard and asked him why he didn't remove my name from Teletrack since my loan was paid in full.He recognized who I was and said he was looking up his records but I still hadn't paid for the loan! He said I would need to contact my employer and to bring in a copy for proof of payment.I went home and got my court records and paystubs for proof. i then emailed him three times with no reply back from him. It's been over 4 years since i paid this off ! i feel I am being treated unjustly and the company I went to said it's illegal to keep a person who has paid up on the report.I'm going to reprt this to the hawaii state Attorney General and Consumer Advocates!

Teletrack reports that kamaaina loan should update them

Per teletrack, the store can update them and it'll be cleared up in 24-48 hours ! Email was sent to kamaaina loan with this request. Lets see if R. Dan updates them or still keeps punishing me ? !

First off I think you should consider it a blessing that no one will give you a payday loan. These loans are bad for the consumer. No one should get them.

So the old loan was paid, but only AFTER they had to take you to court and garnish your wages. Most companies would consider that history a bad risk for another loan. They don't want to wait for months and incur court costs in order to finally get paid.

Tele-track is a credit reporting agency bound by the same laws as the big 3, so you can use the same dispute procedures to attempt to clear up inaccurate reports. Though the original company refuses to correctly report, you can still try to fix it at the credit reporting agency level. Also at least with the big 3, reporting of the status of a judgement doesn't involve the original creditor at all.

If a new company will approve you as long as it was "paid judgement" instead of "unpaid judgement," they should accept your court records as proof.

Go to the Courthouse yourself

Find the Clerk of Court and show him/her your reciept for paid in full on that Judgement. The Clerk will make the notation in the records, and hand you another reciept to take to the credit bureau. Take that to the credit bureau near you and finish the mission.

As they say, if you want a job done right, do it yourself. This may be the only way to fix this. Good Luck.

IF you had paid it voluntarily and not gone to court, they would have to report it as "collection account-satisfied". However, since you went beyond simple collections and you were sued successfully and your judgment was satisfied by wage garnishment and not direct payment, they are not under legal obligation to remove it for a period ranging from 5-10 years depending on your state law. Check your state law for clarification.

This information came from a friend who is manager of a Check n'Go, so she has to deal with Teletrak issues all of the time.

I contacted tele-track to dispute the claim that Kamaaina Loan is refusing to clear up. The reason I didn't honor the check in the first place was that Richard Dan was calling my home and my workplace and harassing me ! He told my head nurse that the cops were going to Hale Makua and arrest me because,"Katherine doesn't pay ANY of her bills". According to him, I would be arrested for, "a worthless instrument".I was having $ problems at the time and I wanted to pay him but he was so angry that he scared me. I don't want to go to his store to bring my papers now because he made a sick commment to me, " I like small blondes" when I was trying to pawn my diamond earrings in the past.He makes me VERY uncomfortable...

In reference to you're rebuttal on my rip-off report:On my notice of denial of customer application for a loan from Easy Money EMG, the teletrack report states,"Shows that some of your past obligations have not been met."The reporting store is Kamaaina Loan and only that company. I know that paying off my loan doesn't clear my credit but according to Easy Money EMG,he should update teletrack after an obligation has been met! They also said that they've called him in the past and he's taken other customers names off tele-track ! I'm NOT ASKING to get my credit cleared up,just to inform tele-track that this loan HAS BEEN PAID ! It is showing an unpaid loan and that's NOT TRUE ! the company said I would of been accepted for the loan if Kamaaina Loan updated them...

IT DOES NOT WORK THAT WAY

If it got to the point that you were actually taken to court, a judgment was entered against you and your wages were garnished in order to collect, it still shows as adverse information, not just on Teletrak, but on the three major credit bureaus. You likely have negative entries under "Public Records" (the judgment and subsequent garnishment of wages),as well as "collections accounts". Just because the owner got his money, it does not clear your credit..the fact it went to court will stay on your record for seven years. Whoever told you it was illegal to keep that information on file was wrong.
