Kenneth S Nugent, PC Ken Nugent Misrepresentation Poor Performance of promised legal services Duluth Georgia, AL, FL

I was in an an auto accident in mid July 2010. I was clearly not at fault so there was no question of liability. Besides extensive damage to my vehicle I was injured, I had bruising to my chest, a contusion on my left knee, and pain in my right shoulder.  I called Ken Nugents office from ads on TV. A representative was dispatched to meet me, discuss my case, and sign paperwork to retain the firm to represent me. As far as I know this person had no legal or medical expertise. In the course of our discussion this man referred me to Active Health Care for treatment of my shoulder, the most serious of my injuries. The other injuries, while painful, appeared superficial.

The next contact was by Mail informing me Atty Russell Deutschman would handle my case and gave me the contact for a case manager. I had a brief conversation with her by phone in which she asked about my health And gave me an overview of how my case would proceed And instructing me to do my part documenting my injuries and treatment.  I had one brief phone conversation with my attorney.  Throughout the case my attorney was unresponsive to my calls and if they were returned at all they were by the case manager, who had no information for the most part.

i was diagnosed with a rotator cuff tear and prescribed physical therapy. I saw Dr Human, OD, 2 or three times. my therapy consisted of exercises 2-3 times per week with a licensed physical therapist And cold, heat, and TENS. I had no improvement in ROM or pain level So after consulting with the law firm I went to see an Orthopedic Surgeon, Dr Darrell Scales. X-Rays and an MRI confirmed the rotator cuff injury, tendon damage, and a crack to the head of my right humerus. He injected the joint with steroids and we discussed surgery.  Any thoughts of surgery were deferred as I had other health issues.

i asked the law firm to proceed to settlement attempts as it had been going on nearly a year. They sent a demand letter but for months I heard nothing.  When I finally heard the call was from a Ms. Todd, a "settlement clerk" informing me they had an offer of $500 and asking me what I wanted to do. I told them I rejected the offer and wanted to speak to my attorney., possibly to file a lawsuit. I never got a call from him.  I wrote him a letter telling him to counter offer $20-25K.  The next thing I got was a certified letter from Deutschman withdrawing as my attorney as he had "exhausted his resources."

i did everything I was told to do for a year and a half but all I found was "One call that's all" meant nothing.  i feel they are not interested in doing any work or helping their clients, only themselves. I have real injuries, real pain, and real medical bills, I have $7-8K In medical bills. The injuries are permanent And now I have Active Healthcare dunning me for $4600.00.  Apparently they never filed with my insurance as I instructed them to do But that's a different complaint.
