I'm customer of Las Vegas Atletic Club. I signed a two year contract for $21.00 a month. At the time I singed my contract I set up an automatic monthly withdraw of $21.00 through my debit card. The first two months the transactions went through without any problems. The following month I got a letter from LVAC saying my account did not have the funds to pay the $21.00 monthly fee. They then charged my account an additional $20.00 late fee.

I immediatly call my bank to find out what the problem was with my account. Nevada State Bank told me that there was nothing wrong with my account. The bank never charged me a NSF fee for the transaction. I then called LVAC, they told me that I would have to bring in a statement from bank proving that I had the funds in my account at the time of the transaction.

I went and got the statement from my bank, providing informations that they, (LVAC) said they would require to prove they had made an error. LVAC looked at the information and told me that this would not be enough to prove that they made and error. At that point, I told them I did not want them taking any money from my account.

I was told I would have to call on the 15th of every month to pay my monthly fees. I agreed and that was what I started doing, but instead of $21.00 a month they started charging me $25 a month. That was not what I agreed to when I signed my contract. I called LVAC and they told me that becauseI did not have an automatic withdraw and this is what they were going to be charging me from now on. I told them to start the automatic withdraw agian.

At first everything went through with out any problems. Now the last two months the same problem has occured. Once agian I went to the bank, the bank told me that there were no problems with my account. They never charged me any NSF fees. That was when, I was told by the person at the bank that they have so many problems with LVAC. My husband took the statements to LVAC and was told that our account would be reviewed and they (LVAC) would be in touch.

To date and several phone calls later we are still waiting for LVAC to contact us and return the money that they stole from our account. I would like to stop anyone else from having to go through this situation. I would like to start a class action suit agianst LVAC.
