We entered into a contract to purchase a home being built by Jason McGregor of Maclum Developments on October 20, 2006. We were to close on this home on December 1, 2006.

I sold my home and closed on it approximately three weeks before we were to close and move into the home being built by Mr. McGregor. It was then that we learned that there was over a twenty-three-thousand-dollar lien placed on the house by the governing HOA as Mr. McGregor never had gotten approval from the HOA to build the house.

In fact, Mr. McGregor had been told in person and through the mail to cease and desist building said home over and over by the HOA. The HOA had been trying to get McGregor to stop building the house for over six months before he went under contract with us to buy the home.

The real estate agent representing the builder, Jill Gilbo of Realty Executives Mountain View, was also told over and over to remove her sign during the same six month period before we were fraudulently induced into a contract.

When we learned of the fraud perpetrated upon us we had already sold and vacated our home. We were forced to live in a hotel for 8 months and our furniture in storage while we found another home. Our out of pocket expenses were over sixty-thousand-dollars.

We have a complaint filed with the Arizona Registrar of Contracts set for a formal hearing on April 6, 2008.

I have also learned that there are a total of four pending complaints against Jason McGregor /aka/ Maclum Developments with the Arizona Registrar of Contractors. I also read on the AROC website that Mr. McGregor's license was suspended for the month of August in 2007 for "lack of bond."

This builder is only in his twenties and has a horrible reputation that is only getting worse.

STAY AWAY from this guy, he is morally bankrupt. There are a lot of great and honest builders out there, Jason McGregor of Maclum Developments is NOT one of them.

As stated earlier in this complaint, we filed a counter-suit against Jason McGregor and added his mother, Norma B. Caucas, and Fernando Cavuto (the other two individuals involved with the house in question).

Norma B. Caucas and Fernando, Cavuto through their attorney, negotiated with our attorney to settle the matter. We were paid a reasonable amount by Ms. Caucas and Mr. Cavuta and they are now out of the case.

Jason McGregor's deposition is set for June 22, 2009.

I was and still am shocked that the Judge granted the Motion to Intervene filed by attorney Paul E Deloughery on behalf of Paul Taggart and Tom Schoenbeck of Keller Williams Legacy One.

This means that these real estate agents are joining the lawsuit filed against my husband and I by Jason McGregor of Maclum Developments.

McGregor currently shows 7 complaints and 3 license suspensions when you look at his record with the Arizona Registrar of Contractors for the little more than 2 years that he has been licensed.

I could not have been in more shock than today when we received a Motion to Intervene as Plaintiffs filed by Paul E. Deloughery of Deloughery Law office on behalf of Paul Taggart and Thomas Schoenbeck of Keller Williams. Yes, they want to join Jason McGregor's lawsuit against us.

I appreciate all that have been trying to help my husband and I in this matter. However, in the future please send all correspondence to our attorney of record. Thank you.

Maclum Developments files a Lawsuit Against Us!!!

On today's date my husband was served at his medical practice with a lawsuit filed by Jason McGregor aka Maclum Developments. This suit was filed by Joel Sannes and Joseph J. Glenn of Lake & Cobb in Tempe, Arizona. The suit was filed based upon the statements that I made on this website. My statements are ALL true. I stand by them 100%. The truth is the ultimate defense in these type lawsuits. The taped telephone conversation between McGregor and myself , taped HOA meetings and transcripts from the Arizona Registrar of Contractors Hearing, etc., etc., will show I am telling the truth. Now it WILL be proven in a court of law who Jason McGregor aka Maclum Developments really is.

When a person is represented by counsel, as we are, and having already gone through the Arizona Registrar Of Contractors Hearing, as we did, one would expect Maclum's attorney to at least give a courtesy call to our attorney to advise him of the lawsuit they filed and wanted to get served up us (especially since we sent Maclum's attorney Joel Sanes of Lake & Cobb a certified letter letting him know that we would be filing suit in June 10the if the matter did not get resolved). Service by Maclum's attorney normally would have been done directly through our attorney.

My Having worked for decades as a court reporter and having a grandfather that was a judge found the attorneys that were true professionals with good ethics would contact opposing counsel in this type situation, especially if they already had a relationship with opposing counsel, as is/was the case in this situation. Service of the lawsuit would then be executed between the attorneys of record. Perhaps if one is trying to embarrass my surgeon husband professionally in front of his staff and an office full of patients this may be the way that one would choose to serve us!

I had been awaiting the decision of the Arizona Registrar of Contractors Judge before posting on this site again. Due to the lawsuit just filed against me and my husband I am now going to update the situations.

We learned at the AROC hearing that Maclum Developments did not build the house that was subject of the hearing and now the upcoming litigation. Exotic Homes built the house. MacGregor's mother Norma B. Caucas of California and her boyfreind Fernando Cavuto bought the home from Exotic. Jason McGregor aka Maclum Developments finished the home that his mother and her boyfriend owned (it was very, very far along at the time Ms. Caucas andn Mr. Cavuto purchased the home).

Maclum lead us to believe he owned the home (as proven in a tape recorded conversation). In reality Jason's mother and her boyfriend owned the home.

We will now be filing suit against Norma B. Caucas, Fernando Cavuto, the real estate agent Jill Gilbo and of course Jason McGregor.

Due to the upcoming litigation I will be having a professional website created that will follow discovery and the trial. This is all public information. I will post the website address very soon.

Jason MacGregor aka Maclum Developments has only had his license since July 6, 2006.

His license has been suspended twice in the less than 2 years that he has had it for lack of bond.

Jason McGrregor aka Maclum Developments has had FIVE (5) complaints filed against him in the less than 2 years he has held his license. Four (4) are still open. One (1) has either been resolved, settled, or withdrawn.

I again challenge you to find a good quality builder that has gotten 5 complaints filed against him/her in less than 2 years of having their license.

Being the owner and founder of Maclum Developments I take offense to everything that is said in the above reports. People like this are the reason great builders get bad reputations and loose the trust of clients. I love my job, and I take pride in every single job we do for our clients so, for her to say these things really bothers me. This feels so childish but I have to defend myself and my company against this slander.

Unfortunately Mrs. T/F didn't get to experience the building process with Maclum Developments. She was not able to see the countless hours that are dedicated to every job and the attention to detail we put into everything we do.

I have many clients that I have built for and am currently building homes for including 2 attorneys, 1 doctor, and many business owners/ entrepreneurs as myself. All of those clients are very happy with the home and I have had noting but compliments and pure joy from all of them. The previously mentioned home (Lot #34) was sold free of any liens or outstanding HOA complaints shortly after Mrs. F/T cancelled her contract. The individual that purchased the home has had no significant problems, and we have not been called back for even a small drywall or stucco repair since it was sold. The house is a phenomenal home and I pride myself and my employees in the great job that they do when constructing a home.

As Mrs. F/T said in the hearing she loved the home and still loves the home. Unfortunately she was not able to purchase the home and purchased a home from another builder that does not spend the countless hours that we spend on every home we build. The attention to detail and new construction methods that we apply in every home are above and beyond any standards set forth for any governmental agencies. We pride ourselves in our finish product, we always use the highest quality materials, and highest industry standards to ensure our homes are the best in the Valley.

I am not a fly by the night General Contractor, I am an individual that prides himself on making the building experience a great one for my clients and providing those clients a great product upon completion of their home. Mrs. F/T is correct a home is one of the largest investments and individual will ever make and we realize this. That is why we try so hard to make the experience as enjoyable as we possibly can.

I actually received a call from the gentleman that purchased lot #34 and we talked about how much he loved the house and he was amazed in the quality "there has not even been a crack in the drywall" was an exact quote. I guess you can say the proof is in the pudding right.

Maybe Mrs. F/T should start complaining about the builder that did not spend the time or effort in the house that she purchased and apologize to Maclum Developments for trying to smear their name because she had a bad experience with another builder. I feel bad for Mrs. F/T and invite her to build a house with Maclum Developments to see what a great experience building or buying a new house really can be.

Todays Hearing Regarding Maclum Developments - Jason McGregor

Today April 8, 2008 we appeared before a judge at the Arizona Registrar of Contractors for the hearing regarding our complaint against Maclum Developments /aka/ Jason McGregor.

The reason that I posted this complaint in the first place is that I am all about consumer protection. If telling my story stopped one other person from being harmed by this builder I am very happy. It is very important to me that the information that I supply to fellow consumers is accurate. I do my very best to make sure that it is. I am telling the truth about what occurred between myself and Jason. I believe that my sources regarding additional information are reliable.

However, I did learn at today's hearing that I was given incorrect information regarding a couple issues that I previously wrote about in my update report.

Jason was NOT trying to sell the house at this time via Keller Williams - agents Paul Taggart and Tom Shoenback. In fact Jason had sold the house to someone else after we cancelled our contract. Based upon Jason's testimony today, it was not too long after we cancelled the contract to purchase with him that he went under contract to sell the house to someone else. That would mean that he still did not have approval from the HOA to even start building the house and that the house was still accruing fines. How do I know that?

I learned today from Jason's testimony that the HOA filed a complaint against him with the Registrar of Contractors the same week that I did. Apparently that complaint was settled in April of 2007. It appears that the fines that resulted in a lien being placed on the house by the HOA stopped at that time as a result of Jason McGregor paying off the lien to the HOA. It also appears that Jason resolved the cease and desist demands of the HOA by perhaps getting his plans approved. I cannot say that for certain as Jason's testimony today was very hard to follow and changed quite frequently.

Jason's testimony was so confusing that I left the hearing at least as confused as I was, if not more than I was, prior to the hearing. Even the most simple question as to who the owner of the house was at the time we were under contract to buy it is unclear.

I do not believe that the Keller Williams agents were involved in the sale of the house to the buyer that bought the house right after our encounter with Jason McGregor. I believe the Keller Williams agents recently sold the house on behalf of that buyer/owner. The recent MLS Listing for this house posted by Keller Williams said "New Home." Based upon the information that I obtained from the HOA and the fact that the MLS did not say "Re- Sale," I did not know that this house was up for sale for a second time. The MLS listing said that the house was built in "2007." I find it very curious that this house has been sold twice in such a short amount of time. Why did the MLS posted by Keller Williams say "New Home?" HMMMM

The Judge that presided over this hearing is awaiting written closing arguments that are due to be presented to him by April 28, 2008. After reviewing said submissions he will make his ruling.

In my employment as a court reporter for many, many years I have seen builders and moving companies as the two most frequently sued professions and in my opinion the two most corrupt.

We now have shoddy work issues in the brand new home we bought that cost nearly two-million-dollars. This was the home that we bought after the Maclum Development saga. We bought a brand new house that has so many problems, electrical, plumbing etc., that our homeowners insurance carrier says that they may no longer be able to insure our home. This was determined after they came out to appraise our home and learned of all its defects.

It was these two encounters with builders that has prompted me to begin work on a website that is dedicated solely to the building profession. There is also an amazing group, Homeowners for Betting Building, that has a very informative website regarding the building industry.

One's home is probably the biggest purchase most people will make in their lives and the wrong choice in a builder could be devastating for the buyer.

I will post the Judges decision both here and on my new website.

I must say again, thank God that we live in a country that affords us the right to freedom of speech. Thanks to the owner and developer of this awesome website in his/her efforts to help protect consumers from rip-offs and fraud we can all work together to help each other from being victims.

Jason's testimony was so confusing that I left the hearing at least as confused as I was, if not more than I was, prior to the hearing. Even the most simple question as to who the owner of the house was at the time we were under contract to buy it is unclear.

I do not believe that the Keller Williams agents were involved in the sale of the house to the buyer that bought the house right after our encounter with Jason McGregor. I believe the Keller Williams agents recently sold the house on behalf of that buyer/owner. The recent MLS Listing for this house posted by Keller Williams said "New Home." Based upon the information that I obtained from the HOA and the fact that the MLS did not say "Re- Sale," I did not know that this house was up for sale for a second time. The MLS listing said that the house was built in "2007." I find it very curious that this house has been sold twice in such a short amount of time. Why did the MLS posted by Keller Williams say "New Home?" HMMMM

The Judge that presided over this hearing is awaiting written closing arguments that are due to be presented to him by April 28, 2008. After reviewing said submissions he will make his ruling.

In my employment as a court reporter for many, many years I have seen builders and moving companies as the two most frequently sued professions and in my opinion the two most corrupt.

We now have shoddy work issues in the brand new home we bought that cost nearly two-million-dollars. This was the home that we bought after the Maclum Development saga. We bought a brand new house that has so many problems, electrical, plumbing etc., that our homeowners insurance carrier says that they may no longer be able to insure our home. This was determined after they came out to appraise our home and learned of all its defects.

It was these two encounters with builders that has prompted me to begin work on a website that is dedicated solely to the building profession. There is also an amazing group, Homeowners for Betting Building, that has a very informative website regarding the building industry.

One's home is probably the biggest purchase most people will make in their lives and the wrong choice in a builder could be devastating for the buyer.

I will post the Judges decision both here and on my new website.

I must say again, thank God that we live in a country that affords us the right to freedom of speech. Thanks to the owner and developer of this awesome website in his/her efforts to help protect consumers from rip-offs and fraud we can all work together to help each other from being victims.

WOW - WOW Jason McGregor /aka/ Maclum Developments Needs A Reality Check

Jason McGregor sure gives a glowing report on himself. What he has to say in his self-serving report couldn't be further from the truth.

I have a tape recorded conversation between Jason and myself in which he tells me that he has a terrible reputation as a builder. In my opinion he isn't any better as a person. It generally takes a builder some time to get such a bad reputation but Mr. McGregor has managed to get a bad reputation in very little time in the business.

He is NOT on good terms with the HOA. If the HOA had anything good to say about the builder why did WE serve a subpoena on them to attend and testify at the Registrar hearing? We have gotten copies of two taped HOA meetings (for the upcoming hearing before the Arizona Registrar of Contractors) during which the HOA is confronting Jason McGregor about his continuing to build a house in their community that he was ordered to stop building. During the meeting Jason McGregor is saying things such as "Give me a break, I am a young buck just learning." Yes, he actually says this and other things indicating that he does not know what he is doing. Clearly, the guy doesn't know what he is doing, however I do believe that he pleads ignorance to try to get away with his unethical practices.

We also have copies of 5 months worth of letters that Mr. McGregor /aka/ Maclum Developments had received from the HOA ordering him to cease and desist building the house. In spite of his receiving said letters he and his real estate agent Jill Gilbo enter into a contract with us to buy the house. Not only is there fraud on the part of the builder, but also on the part of the real estate agent as well. She too had been receiving letters from the HOA regarding this property. We have a pending complaint against Ms. Gilbo and her broker before the Arizona Real Estate Commission. People that live in that community have told us that they believe Jill Gilbo and Jason McGregor had a romantic relationship because at the time that we were under contract to buy the house the two had been seen at the property behaving in such a way that would indicate a romantic relationship. I don't know whether or not that is true as I never witnessed this myself. That would however explain why Ms. Gilbo would be a party to the fraud that the builder perpetrated upon us.

The purchase of this house did not fall apart based upon whether or not we would be permitted to build on to the the existing house. On the contrary the contract was canceled because the builder had no authority to build said house, PERIOD. There was a lien on the house (23K found by the Title Company right before we were to close on the property). The lien was placed by the HOA as the builder was ignoring their cease and desist letters and kept on building the house, so they kept fining him. We did want to build an addition on to this house, but whether or not we could was not going to make our decision as to whether or not to buy the house as is. Unfortunately the decision was made for us because the title was not clear, the house had a lien on it and the HOA was considering legal action against McGregor. Who in their right mind would go forward and buy a house that likely was heading toward litigation between the builder and the HOA???????? Unless one had cash to pay for the purchase in full the bank would NOT approve the mortgage under these circumstances. I know this because our mortgage was approved until the Title company found the lien. Whether or not we wanted to still buy this house didn't matter, the bank said NO WAY are we going forward with the mortgage.

Please do a search on the web again to find and read the website that I have currently under construction regarding McGregor /aka/ Maclum Developments. This website will detail the manner in which McGregor handles his business dealings. The website will have sound so that you can hear in McGregor's own voice and words what he had to say to defend himself at two HOA meetings regarding said house and to me on the telephone. I will also include in full detail the result of the April 6 AROC hearing as well as details on the civil suit that we are in process of filing. If you know of any more victims of this builder do contact us as I believe our lawsuit is going to have multiple plaintiffs.

A home is probably the most expensive thing that you will buy in your lifetime, so having accurate information about your builder is a must. You do not want to make a mistake in what builder that you chose to do business with as this transaction could turn out to be the most costly nightmare of your life!

Jason McGregor /AKA/ Maclum Developments currently has FOUR pending complaints before the Arizona Registrar of Contractors. I challenge you to find a reputable builder that has FOUR pending complaints. There are NONE!!!

The couple was very specific when purchasing the home , and actually made it a condition of their contract that they would not purchase the home if they could not also build a guest home. Maclum Developments contracted with an architect to draw the guest home for submittal to the HOA and Design Review Committee and everything was ready. When the plans to build a guest home were not approved by the neighbors and the nearby golf course, the contract was voided per Ms. Blakes request. Maclum developments has sold 2 homes in 1 year with both selling for record breaking square foot prices in the mentioned sub-division. We have 2 currently under construction with plans to be build 4 more over the next year in that very same sub-division. We maintain a strong relationship with the community and have some great personal relationships with its residents.

It is not productive for us to try and debate these "potential buyer's" claims and
complaints point by point over the internet. Maclum Developments has a long list of homeowners who love the homes Maclum has built for them and appreciate Maclum's attention to quality and service.
