I have received a letter from Midland Credit Mngmt. basically stating the same thing they had written to Bee Informed. The only difference is that they would resolve the account for 75% off the current balance. I will follow through with them and ask them to validate this fraudulent debt. I did call the 800 number and when I refused to give them my social security number they hung up on me.

#3 Consumer Suggestion

Camil's response is laughable. Just another illiterate bottomfeeder!

This is a classic example of what you are dealing with at most collection agencies. Illiterate morons. NEVER speak to any third party debt collector on the phone!! NEVER!!

Camil, let me clue you in. You are supposed to have already verified the debt and already know who you are speaking to before first contact. This is called due diligence. Any other contact, not previously verified is called FISHING. That is the problem.

You need to learn how to spell, and use proper grammar, etc. Some capitalization and puctuation is nice too.

FYI...There can be no wage garnishment if the debt is not validated, because if a lawsuit is filed in response to a validation request, I can get it tossed in 3 minutes. Also understand that you cannot garnish anyone's wages without first suing and winning.

Also understand that the entire burden of proof is on the collector. The "debtor" is not required to give you any information at all.

My suggestion: Go back to school, learn how to read and write, and get a real job.

how are they suppose to know if they have the right person or not your name is pretty common so there for they need to vi. besides really what are they going to do with it its sitting right on there screen anywat the reason they ask you to varify is so that a there talking to the right person and b so many debtors lie about it. also if there offering you that much of a discont you should have taken it because that never happens but hey its only going to hurt you one way or another they will get there money besides if it goes to their attyns then you could be looking at wage garnishment maybe it would be easier to just pay the money you owe

Midland does have a seedy reputation

It's not good practive to seek the verification of the debt over the phone or talk to them on the phone unless you are taping the converstaions and most states vary regarding taped conversations if you must provide notice to the other party, etc. You need to do this in writing, sending them a certified, return receipt letter and type your signature. Do not sign it yourself. This prevents possible forgery from bottomfeeding 3rd party debt collectors. These low life scum will do anything for a buck.

If, in fact, you find out this is a valid debt then don't verbally accept payment terms. If you pay according to their terms, they will probably deny they made you this offer and seek more money. These bottomfeeders just want their commissions. Make them put it in writing.
