DIARY OF EVENTS.

 

On or about 6^th March 2009.Seamus Power ,member of the Victims of the Legal Profession Society.(V.L.P.S.) introduced me to Mr.Alan Evans at a meeting which took place in the Kylemore restaurant, Town Centre, Waterford.

Alan Evans posed himself as a legal eagle who knew how to challenge the Irish State, and over a series of meetings between Alan and Patrick and  Mrs.Patrick, he informed us that he was the owner,director,treasurer and manager of his company called The International Private Investigations Services and International Solicitors.(I.P.I.S.I.S.) and he agreed to take our cases against two Irish Health Boards, The Irish State and others, and informed us that he would be with us right to the end.

A lay Litigant from Cork,Mr.Liam Madden was delegated by Alan to represent us in court,and at a meeting with Mrs.Patrick and Patrick and Alan, Mr.Madden agreed to represent us.He informed Mrs.Patrick that he had her case and papers and was taking her case on.

Liam later confirmed to Mrs.Patrick that her case was in his hands and that he had further instructions from Mr. Carter in Canada to hand, and that he would contact Mrs.Patrick when he had examined same.

Alan informed us that Mr.John Frederick Carton who was living in Canada, was his company  Barrister, and that Mr. Carton would read our files and produce a strategy report and come to Ireland to fight our cases.

Having agreed to pay for Alans services we made several payments totaling  eleven thousand six hundred sixty euros, all contact was lost between Alan Evans,  Brian Sweeney [ his minder ], and Liam Madden shortly after we had made the last payment .

Meeting at 11.pm in Grand Hotel with Alan,Liam Madden,Mrs.Patrick. Brian Sweeney was seen just before us.Liam accepted Mrs.Patricks case and stated that he had her file papers.

23^rd.March.Mrs.Patrick paid  one thousand one hundred euros into Alans account.

15^th.April 2009. Bill for nine thousand five hundred and sixty euros and twenty cents received from Alan for our joint case against the Health Board and other.

24^th.April 2009 .3000-00 euros paid.

25^th.April 2009. 3000-00 euros paid.

27^th April 2009. 3000-00 euros paid.

28^th.April 2009. 250-20 euros paid.

28^th April 2009. Mrs.Patrick phoned Alan about the unexplained delay in her case and he said that he had been threatened at gun point,had gone to the Gardai,was leaving and going to a safe house under police protection and had to lie low for a while.

29^th April 2009. Mrs.Patrick phoned Alan and he stated that he had to lie low and that the police had him in a safe house.Call ended.

4^th May 2009. Mrs.Patrick phoned Alan and he said that death threats had been made against him,the Gardai had been informed and he now had to lie low for a while.

11^th.May 2009.

12.30 pc.from Seamus Power to Mrs.Patrick.He said I will give you money to go on holiday, and you dont have to pay me back, it will be a gift.He said that he will give money to Patrick. Mrs.Patrick declined the offers.Mrs.Patrick said that we did not trust him.

Pc from Alan who stated that his home had been broken into and files had been taken.

 

12^th.May 2009. Pc from Alan to Mrs.Patrick and he stated that Gardai forensics were there at present.

 

15^th May.2009.

Mrs.Patrick phoned Alan at 11.00am. No answer.

Mrs.Patrick phoned Alan 5.30 pm No answer.

18^th May 2009.

Mrs. Patrick and Patrick phoned Liam Madden A.M and P.M. No answer.

 

19^th May 2009 . Missed am.call from Liam Madden.

20^th May 2009. Patrick. Two phone calls to  Liam.  No answer.

21^st May 2009

9.30 am call from Liam Madden to Patrick. He said he could not do our case, and that he had lost contact with Alan.

Liam said that he would send our files to us by email tomorrow.

22^nd May 2009.

No email came from Liam Madden. Patrick phoned Liam and he said that the files were too big , and not possible to transmit.

24^th.May 2009.

Patrick phoned Liam, and he said that the file access code had been changed by Alan, and that he could not access them.

Mrs.Patrick. Phone call to Alan. No answer.

25^th.May 2009.

5.00 pm. P.C. by Patrick to Brian Sweeney, and asked for a meeting with him. He said he was too busy, and wanted to know what it was about.

7.00 pm p.c. from Brian. He set up a meeting for 10.30 am. In Dooleys hotel Waterford in the morning.

Pc. from Brian Sweeney, who informed me [Patrick] that Alan, himself and others who were claiming that they had suffered abuse were meeting tomorrow .I asked to attend, but he said it was only for them, but he would tell Alan about our concerns. He assured me that he would contact me after that meeting tomorrow.

An Garda Siochana are the Irish Police Force. Garda means Police Law Enforcement Officer.

 

10-June-2009. Waterford Garda Station.First visit.

9.p.m.Patrick and Mrs.Patrick went to Waterford Garda Station and we reported the Fraud to Garda Alan Kelleher [W K 112.] we said that we had paid out over eleven thousand euros. Garda Kelleher stated that because the amount was so high, that a detective would be in contact with us. He took details, but  declined to take our statements.

12^th.June 2009.

Mr.Patrick pc.to Liam 10.45  no answer.

Pc. From Liam 11.00 said he would do the letter for me to the courts,and said that we should go to the Gardai about Alan.He said that he would testify against him.He asked to be reminded by Mrs.Patrick about the letter.

13^th June 2009.

14^th June 2009. Second visit to Waterford Garda Station.

Mrs.Patrick and Patrick asked to see  Sergeant Mick Wheelan ,but Garda Ciara Collins informed us that Sergeant was on the phone and showed us into a small room. She returned after a while and stated that the sergeant had to go to court and was unavailable. We informed her that since our complaint was made on 10^th last. No one had made contact with us about the matter. Patrick gave her a three page account of the events to date ,and information about the fraudsters. She said that Sgt. Mick Wheelan would be on duty from 2.00 pm tomorrow, and that she would pass on the details to him.

15^th.June 2009. Our third visit to Waterford Garda Station.

We called in at 4.00 and spoke to Garda Martina Felle,  and she informed us that Sgt.Wheelan would not be in until 9.00.pm.,and that our case was being dealt with by Garda John Cashman in Ferrybank Garda Station.

We asked to see the Sergeant on duty. The same interview room was used, and Sgt. Larry Sheehan  [I.D.number wk 242 ] informed us that Garda Cashman was transferred to another place called Moincoin.

We again gave the details, and after a long wait, Sgt,Sheehan returned with another casually dressed man Mr.Paddy Kelly who stated that he hoped to be a detective one day. Both men were at difficulty as to whether the nature of our complaint was of a criminal nature. They agreed to send it to Dublin for further analysis and said they would be in touch with us.

25^th June 2009. At 9-55 am. Phone call received by Patrick from Garda Paddy Kelly who stated that he was investigating our complaint, and that he would be in contact to  take a statement next week..

3^rd.August 2009. Nothing had been heard from Waterford Garda to date. Two months  since our formal criminal complaint was made to Waterford Gardai, and no statement has been taken from us on the matter to date.

Dear Chief Superintendent Murphy,

 

Two months ago we made a formal criminal complaint to Garda Alan Kelleher at Waterford Garda Station. We gave details of our loss of eleven thousand euros taken from us by Fraud and Deception by Mr. Alan Evans.

 

Would you kindly investigate the matter and advise us as to why we have not yet been asked for any statements, and the reason for the long delay.

For your convenience we have set out below a diary of events on this matter to date.

3^rd. August 2009. Letter sent to Chief Superintendent P.V.Murphy.Waterford Garda Station.

3^rd.August 2009. Copy of reminder sent to The Garda Commissioner Mr. Fathna Murphy.An Garda Siochana Head Quarters.Pheonix Park Dublin.

4^th August 2009.Acknowledgement from Chief Supt.Murphy.stating that he had forwarded our letter to Superintendent Delaney Waterford Garda Station stating that we would hear from him in due course.

11^th August 2009. Acknowledgement from Philip J Doolan Private Secretary to the Commissioner stating that our correspondence had been forwarded to the Deputy Commissioner of Operations,An Garda Siochana,Garda Headquaters,Phoenix Park.And that we will be communicated with further in course.

24^th.August 2009.9.22 am.Message on my mobile phone from Garda Paddy Kelly Waterford advising of a meeting with him to take place on Monday 24^th.August at 8.00 pm for the purpose of taking a statement.

12.15 pm. spoke with Detective Sergeant Anthony Petit.the Crime Unit Waterford Garda Station who stated that he knew about our case.We confirmed the appointment.

24^th.August 2009. Patrick and Mrs.Patrick  went to Waterford Garda Station at 7.55 pm.We met with Detective Garda Eamon Dumphy and Garda Paddy Kelly. Det.Dumphy when we asked to make a joint statement, he declined and stated that we would be required to make separate statements and that Mrs.Patrick would go with him, and Patrick with Garda Kelly.They took our statements and when we asked for copies of same, they declined to give us copies while stating that we could apply in writing to Supt.Chris Delaney for same, and in our application, say that it was for the purpose of our records.

25^th.August 2009.Patrick and Mrs.Patrick applied in writing to Supt.Delaney for copies of our statements.

2nd.November 2009.Reminder letter to the Garda Commissioner asking for a response, and stating that we had not heard anything.

6th.December 2009. Another reminder to the Garda Commissioner asking for a response.

10th December 2009.Letter from Garda Kelly stating that he was still investigating.

15th.February 2010.another reminder to Garda Kelly sent and copied to the Garda Commissioner Fathna Murphy.

3rd.March 2010  No result yet.The wait continues.
