This company intimidated me to make payment for my dell account which was in collections (due to another fraud debt settlement co. which i didnt know they were at the time)!!! i already explained to her that im in a debt program and she has to speak with my attorney.,i am not to have contact with them. they used their fraud tactics but i told her i dont have the money and i dont know when i will have the money, but she said to just make a post dated payment she said that she will call me a week later to confirm the payment, and if i still didnt have the money i can change the date, and get 10 days more to come up with the money, to just have it in the system that im trying to handle the debt.

That same day i called back to cancel the payment made over the phone, because i started getting suspicious.. at first they said they cannot cancel it as it is already in the system, and to contact my bank to place a stop payment..i talked to the supervisor and finally after trying to persuade me to keep the payment they said they "cancelled" it.

A couple days later, i get more calls from NCO..my home phone and my cell phone!! ridiculous amounts of calls within a short period of time! of course i dont answer. finally i call from my cell and request they not contact me anymore., and to contact my attorney. literally a second later i get a call on my home line!, im really upset at this point for their childish antics..they apologize for the for the 'mistake' of calling me. i ask to speak with the female that is handling my account,..im in midconversation with her and she goes to look something up and im put on hold! then im disconnected! i call back not even a second later and ask to speak to that girl again and am informed she left for LUNCH!!

im fed up and go to my bank to place a stop payment and make a fraud claim..today i just found out the payment went through! my bank is still investigating and i should hear from them soon. i just called NCO and spoke to the supervisor. he tried to tell me that he's not supposed to be talking to me but with my attorney!! then why were the contacting me prior to that?!!!! also he says the last time i spoke with that female was the 12th. first of all I NEVER HAD CONTACT WITH NCO UNTIL THE 15TH AND ON TOP OF THAT i spoke with THEM numerous times after that, I HAVE MY PHONE BILLS TO PROVE IT!!he said it shows it was cancelled and he doesnt know why the payment went through..i told him that company is FRAUD just like they are, and im handling my account again..he then tells me i need to contact DELL FINANCIAL now and they are not taking care of my account because its out of collections..(yeah, BECAUSE THEY TOOK PAYMENT WITHOUT MY FINAL CONSENT!!!!!!!!!!!!!!!)FRAUD!!!!!!

Oh yeah...One more thing re: 1099's from collectors..

Kathy,

As per IRS rules, only the person who deducted the loss such as the original creditor can issue a 1099. Many collection agencies have been busted for this unethical and illegal practice.

And, it actually works in your favor for the original creditor to do this. This is beacause at the time they do that the money is considered a gift and the account is satisfied. Nobody else can ever collect on it and it cannot be sold.

I loved when my creditors threatened me with that. My response was, do it today! You only pay the taxes on the amount, or you can play it both ways and use it against them. You file a dispute with the IRS on the 1099 and say you never recieved that amount of money from them. Then they have to put in writing to the IRS the proof and that they gave you the money as a gift, etc.. They don't want to do this.

You win either way. The 1099 thing is an empty threat and they know it.

The first rule is to NEVER call a collector, and to never take thier calls. NEVER speak to them on the phone. Conversation will NEVER do anthing good for you, and most times makes the situation worse.

The second thing is to NEVER contact the "original creditor". Once assigned for collection to a third party collector, or sold to a junk debt buyer, they CANNOT legally speak to you about the account or take a payment. It would be fraud.

Keep in mind that paying on any collections account re-affirms the debt and now makes it legally collectable, where it may not have been. AND, it actually hurts your credit more than just letting it go! Once you have a collection on your credit, the ONLY thing that helps is time, 7 years! NEVER pay on any collection account!! Even if you pay it in full, it does not remove the negative from your credit report. It actually restarts the 7 year negative reporting.

IGNORE all collectors. Change your phone# to an unlisted one, get a private mailbox then, etc..Make it look like you moved. And when you get a letter from them, DO NOT even open it! mark one line through the address to you and mark it "not at this address" or "deceased", etc..Then drop it in a big blue mailbox. Take down your house mailbox, put a different name on your house, etc..

The only thing you never igmore is a summons. However only about 1% of collections ever go to court. I like those odds!

NCO is the largest offender of consumer rights in the nation. This comes right from the FTC.

I have received 2 letters from nco financial. when I called the number to get info on acct. I reached an automated system which requested that I leave my phone number and acct number. i immediately hung up. this is one EASY way for them to get your number. on the bill it should tell you which company they are trying to collect for, call this company first. they can verify that you do or don't owe and how much and when debt occured. If they don't have information as to what is owed then you have more to fight collection company. I called JC penney they had no records of my having an account ( delinquent or otherwise). again collection ocmpany ahas to be able to provide proof of account owed ie: statement(s) from company they are trying to collect for.
also beware when they tell you they will accept lesser amount. what ever amount you don't pay they will send 1099 form & you can be taxed for that amount.
