New Image Lasik Center rip-off! They closed and I still need follow-up care and enhancement surgery. Now I'll have to pay twice. Phoenix Arizona

I had my PRK surgery done late November 2003 at New Image Lasik Center by Dr. Kevin Belville. I was supposed to receive my follow-up appointment and then an enhancement surgery in April 2004. When I called a week before my enhancement surgery date to confirm my appointment, I found out they had gone out of business.

After receiving the intial surgery, I could see clearer, but because my vision was pretty bad, I was going to need an enhancement. Now that they have closed, I am stuck still wearing glasses otherwise I would not be able to see clearly. I have sent an email to them at the email address they left on their answering machine recording regaring this issue, and they have responded. Here is their response:

Dear Former Patient,

As you know, New Image Lasik Center of Phoenix, LLC has closed for business. Since you have inquired about post operative care, New Image Lasik Center is referring you to Advanced Perspectives Eye Care, P.L.L.C.
at 4901 N. 44th St. Ste 102, Phoenix, AZ 85018, 602-955-2700.

Advanced Perspectives Eye Care is a private, separate entity that has agreed to care for New Image Lasik's former patients and will consult with you regarding post operative care, enhancements and any further surgery.
If and when you, as a former New Image Lasik patient, choose to be seen by Advanced Perspectives Eye Care, there may be a fee attached to cover expenses.

Advanced Perspective Eye Care's fee will be based on the extent of the services requested by each specific patient. Advanced Perspective Eye Care's independent optometrists are not obligated to provide your post operative care or future enhancements going forward and their agreement to do so will depend on their review of your vision treatment records.

We thank all of our loyal patients and were happy to have been of service improving our patients' vision. We apologize for any inconvenience and wish you the best of vision in the future.

I have gotten in touch with Advanced Perspectives Eye Care and have obtained a copy of my medical records. When I asked about receiving the 1-year enhancement surgery that was included with the price I paid at New Image, they informed me that they did not do Lasik surgery at their office, but could direct me to a doctor that would do it. Of course, this means, I would need to pay for the surgery all over again. Is anyone interested in filing a class action lawsuit? If so, please email me.
