Option One Mortgage Corporation Fradulant claims unlawful suit, theft Irvine California

Option one has took us for a ride from the moment we got our loan with them in 02.

We have had to deal with them charging us for things that we don't know about. They have raised our payments up $200.00 since the initial payment. They have broke our contract agreement three times before they tried to foreclose on our home.

Once the foreclosure began they would not tell us why when we tried to pay our payments they refused them, or why they wanted us to pay 500.00 more then what was due. This was before we even started the battle over foreclosure. They then wanted us to pay them $805.05 a month for a year along with a 2,800.00 dollar deposit which we did. In sept of 07 we finished the program that we had been put on to keep them from taking our house only to find that they had used the money for other things and did not put it toward our monthly payments.

Our contract stated that once we paid them the 12,400.00 then our account would be current, we did and now one week after the contract was completed they tell me we are two months past due because they did not put the money we had been sending on our mortgage payment they could not tell me what they did pay with the money. Nor will they tell me what was the purpose of the contract if they had no intentions of keeping there end of the agreement.

On top of all this they keep reporting to the credit agencies that we are over 30 days past due even though we have our contract and every pay receipt where we paid and kept up our end of the agreement. Therefore we are not able to refinance with anyone else even though my credit is good enough to do so.

I have contacted many lawyers one which told me to file a class action suit against option one. I have come to the conclusion that I am tired of talking to them and getting the run around so this is where I am at. I have scheduled to talk to some Lawyers to see what my options are and hopefully will get some results.

Oh and Option one sent me a letter two weeks before my repayment agreement was up telling me we had over paid. When I called about the amount and what happen they ask that I give them 72 hours to research, I gave them 5 days since they do not get things done when they say they will unless it is to suit them. I was told my loan was not suppose to have been put into foreclosure and that the $550.00 check that was sent to us was to pay back some of the money I overpaid for their legal fees and foreclosure fees.

After many days of requesting information and getting no where one of the operators informed me he did not know about the check or why it was sent, he also stated that he did not have any information on the possibility that they foreclosed when they were not suppose to. I want to try and file a class action suit against Option one.
