Last summer June 1999 a young salesman from Orkin Pest Control knocked on my door and said that he was in the neighborhood and his company had a promotion. He said that several people in my neighborhood used Orkin and would I like to try them. I said I have my own exterminating company. He said he was a college kid who worked for Orkin part time and how great Orkin was in preventive maintenance.

Once a month they would spray my house interior and exterior, even the pipes for $38.00 a month. I told him he could spray that day and paid him by check then for $38.00. He said that I
needed to sign a contract for a year. I said he could spray that day and I would pay him for that service - $38.00.

He did and I never signed a contract with Orkin. Since then, an Orkin Exterminator would come to my house(without permission) when no one was home and spray my home's exterior.

I called them to tell them I did not want any present or future
service and since I did not request service I was not obligated to pay for it. Every so often I would get a bill from Orkin for service I did not ask for ($72.00) I have called them several times and all say that they would check into it and get back to me. I am not only still getting bills they have sent a collection agency on me. I explained to the collection agency
that I did not sign a contract with these people and am not liable for these charges.

No one does anything, and now I am extremely frustrated with this organization. This minimal amount of money is nothing compared to the grief and aggravation and it shouldn't appear on my credit report.

I would like these people to issue me an official zero balance. Is this the way they make their money? Can you help me?

The only thing that bothers this company is the enviromental protection angency. If they have applied commercial pesticides to your property without permission, then they are in violation of state/federal law and could lose their license. I would contact your State dept. of enviromental protection-Pesticide management div.

I am employeed by a competitor of Orkin and other pest control companies. I am familiar with pest control contracts and service agreements. You should request a copy of the contract that they claim you signed.

Realize that you may of signed "something" thinking it was not a contract. If you signed a contract, then you are responsible for what you signed for, and there is no help for you.

If you did not sign "anything", then you have not given Orkin permission to service your home, and are not liable for payment for services not authorized.

If the company failed to receive a signature, then it would be their error and loss. I don't think that they would of persued collections procedures without reveiwing your file, and paperwork for a signature.

A signed contract would mean that you have given Orkin permission to treat your home for one year and that you agree to pay them for those services. It sounds like the sales rep mentioned the year service, but you wanted something else from him. You wanted a good deal, with no further commitment.

Orkin gave you this discount (where they probably performed the service for less than cost)under the understanding that you would be willing to complete the one year service. They invested in you, but must of misread your intentions.

Even though Orkin, and other companies are our competitors, I wish them luck. I hope no company will make the mistake of allowing themselves to be taken advantage of by you again. You don't deserve a pest control service.

Exterminating services you must have asked for

For starters Orkin Pest Control does not use collection agencies. Orkin does all of their billing and collections. Anything on your credit report was not put on there from Orkin. Orkin does not service one time for $38. If you had Orkin spray one time it would have cost you more than $38. As a protectant of itself Orkin would not put you into the system without a signed contract. Therefore, if you had somebody come out every month you had to be in the system, if you were in the system, you had signed a contract.

People who have a signed contract and that are in the system are always verified by a customer service rep before the service ever begins. Verification includes time and day that service will take place. On the signed contract is the statement of what will happen if you are not home during your verified time and day and how to remedy that situation.

Furtermore, when the outside of your house is sprayed a service ticket is left on your door, If you hadn't signed a contract shouldn't that have been a red flag to you? People always try to find ways to escape paying for services rendered, maybe you should read your signed contract a little more thourghly!!
