I don't know who these people are, but I am so mad about this. This just screwed my credit. A past due balance of $1,811 for 3 years that just showed up now? I have no idea what this is about and am mad. How can I get a hold of these people? I need to talk to them. I had an account with ATT 4 years ago but wasn't delinquent and want to find out how to rectify this.

What to do....

AUTHOR: Credit Resuscitators - (U.S.A.)

POSTED: Saturday, March 13, 2004

Well, the first thing you need to do is contact Palisade Collections. Palisade Collections

Address:
2425 commerce ave
duluth Georgia 30096
U.S.A.

Now, you need to get yourself a good letter of dispute. Here you go:

Full Name Today's Date
Current Address
Current Phone Number

Equifax Credit Information Services (Experian or Trans Union)
P.O. Box 105873
Atlanta, GA 30348

Dear Credit Bureau,

This letter is a formal request to correct inaccurate information my credit file maintained by your organization. The item listed below is completely (Select the appropriate word(s) {inaccurate, incorrect, incomplete, erroneous, misleading, outdated} and insert here} and is a very serious error in reporting.

Line Item: {insert name of creditor, account number or line item number, and item description here} (found on your credit report) Additionally, I have enclosed a copy of a credit report your organization provided to me on {insert date of report here} and circled the item described above.

Under the federal Fair Credit Reporting Act, Credit Reporting Agencies are required to maintain and report only 100% accurate credit information and to investigate any claims of inaccuracy within 30 days of receiving such a claim.

I respectfully request you investigate my claim.

If after your investigation, you find my claim to be valid and accurate, I request that you immediately {delete, update, correct} the item and supply a corrected credit profile to me and all creditors who have received a copy within the last 6 months, and the last 2 years for employment purposes. Additionally, please provide the name, address, and telephone number of each credit grantor or other subscriber.

If your investigation shows the information to be accurate, I respectfully request that you provide me with proof of the accuracy of the item in question, specifically any contract, note or other instrument bearing my signature. Additionally, within 15 days of the completion of your re-investigation, please forward to me a description of the procedure used to determine the accuracy and completeness of the item in question.

Sincerely,

Signature
Printed Name SSN# 123-45-6789 (only to reporting agenc, NOT collection agency!)

This can be modified to be sent to the collection agency. We recommend simply contacting them; that means you are giving them LESS time to respond and this is less time you will be waiting. By cutting out the middleman (reporting agency) Palisade will now only have 30 days to respond DIRECTLY to you. One more thing, DO NOT PUT YOUR SS # ON THE LETTER TO PALISADE!!!!! Only to the reporting agencies!!

Next, you will probably receive a letter that says they need more information (IE your social security number) REFUSE. Write a follow up dispute letter. Explain that you refuse to provide private information and demand again that they ether verify the debt, or cease reporting it. Here is a sample:

RE: Dispute Letter Dated {place the date of your initial letter here}

Dear Credit Bureau,

This letter is a formal notice that you have failed to respond in a timely manner to my letter dated, {place the date of your initial letter here}, and deposited by registered mail with the Post Office on that date. For your benefit, and as a gesture of my goodwill, I will restate my dispute:

Line Item: {insert name of creditor, account number or line item number}

Item description: (found on your credit report)

The item: is completely (insert appropriate word: inaccurate, incorrect, incomplete, erroneous, misleading, outdated) and needs to be corrected immediately. I have enclosed a copy of your organization's credit report dated {insert date of report here} and for your convenience, circled the item described above.

The Fair Credit Reporting Act requires you to investigate and respond to my dispute within 30 days, yet you have failed to do so. I feel it necessary to remind you that you may be liable for your willful non-compliance and that I am maintaining a careful record of my communications with you on this matter, in case your continued non-compliance forces me to file a complaint with the FTC. (See Title 15 USC 41)

Please do not delay further! {insert the appropriate word here} (Delete, Update, Correct) the information identified above and send me a corrected credit profile and to all creditors who have received a copy within the last 6 months, and the last 2 years for employment purposes and the name, address, and telephone number of each credit grantor or other subscriber.

If your re-investigation was negative, please supply the description of the procedure used to determine the accuracy and completeness of the information to my address above.

Sincerely,

Signature
Your Printed Name

HOLD THEM TO THE DATES! Do not give them ANY LONGER than 30 days! If they fail to resolve the issue by the end of the second 30 days, begin filing complaints. The FTC is a great place to start. You can also file with the attorney general of their operating state, you can find out from you own state Banking Department if they have a local office or are even licensed to collect in your state; if so, file a complaint with the Banking Department.

Small claims court is another route. For failing to verify the debt, if you win they would owe YOU $1,000.00. It is very important that you keep accurate records of all correspondence with Palisade, and mail all of your letters registered, return receipt mail. That means someone on their end must sign for the letter and then you have proof they received it.

Good luck to you!
