I authorized Phoenix Remanufactured Transmissions, 2620 N. Scottsdale Road, Scottsdale, AZ to install a remanufactured transmission in my 2001 Dodge van after studying a slick glitzy internet webpage showing state of the art facilities and equipment. The shop where the work was done however is a dirty little rathole in Scottsdale with a cramped un air conditioned installation area and technicians coated with grease.

These repairs took an excessively long time spanning over a month despite a verbal promise by the end of the first week. I suffered numerous promises of completion always with another excuse why it was not done yet. This caused extreme hardship due to downtime of my vehicle. When I picked up the van the shifter did not work properly and there was extreme vibration in the drivetrain accompanied by a burning smell. I had to take the van back to the shop and they admitted to incorrect parts being installed and they kept the van for another few weeks while they attempted to correct their original mistake. When I picked up the van again on October 5 the shop had left the windows open allowing dirty rain to damage the interior. The van was also covered in greasy hand prints. Both rear doors of the van contained large vertical dents that were not present when I had dropped the vehicle off for repairs. Phoenix Hard Parts claims that damage was already present on the back of the van, which is an outright lie.

There is excessive vibration in the drive train which will require another shop to address as I have no confidence in Phoenix Remanufactured Transmissions repair ability. When I asked for compensation for the body damage the shop manager told me they had another customer's van on their lot that had nearly identical damage to the rear of the vehicle. These large vertical dents are high up on the door and appear to have been caused by carelessly backing into a piece of equipment on their premises as there is no damage to the bumper whatsoever. The repair lot is cramped and small so it is no surprise it got damaged after sitting there for about a month. The management is hostile and rude and the repair personnel incompetent. They caused additional damage to the vehicle while it was in their possession and the repairs made to the transmission are unsatisfactory.

My advise to others who are reading this is to seek an attorney specializing in consumer matters before doing anything else as these people are clearly able to manuever around their own incompetence and mistakes while still shafting their customers out of thousands of dollars. A representative of Phoenix Hard Parts also implies that I am attempting to defraud them, essentially calling me a liar. For what its worth, I'm a good guy and I don't try to rip off anyone. They did this to me, then dare to call me a fraudster!!! I will see what my attorney says to do next and go from there.

Julius,

When my 2001 Dodge van broke down on the road test as you told me about on the phone, by what method was the van returned to your shop?

What was the name of the tow truck driver, or tow truck company, if it was returned to your shop by tow truck?

If it was not moved by tow truck, then was it pushed by the four-wheel drive vehicle I saw on your lot, with the two high vertical bumpers attached to the front?

My insurance agent would like to know. Thanks!

As for cab fair, we cannot reimburse you for that. Our initial check sheet shows damage on the side of the van and rear of the van. I really cannot be sure WHO is at fault for the dents, but we may be open to help. If you feel more comfortable threatening us and you feel that this will accomplish your goal then so be it. If you continue to threaten us, you can be assured that we will not help!! We would also reimburse you for a $13.99 car wash at Danny's Family carwash, please submit the receipt to the Scottsdale Location.

My response to the response as quoted:

1. In reference to "Please call the dent guys in Scottsdale"
a. who are the dent guys thats quite vague
b. why does this estimate have to be performed in Scottsdale I live 30 miles away
c. It's my property that was damaged by your company I will decide where it will be repaired, not you

a. what is there to decide, you damaged my equipment and you must pay for it as long as this estimate is within what is reasonable for this type of damage

In reference to "As for cab fair, we cannot reimburse you for that".

a. I had to make an additional trip to your shop to pick up my vehicle a second time, because your company did not get it right the first time.
If it was right the first time, and your techs had actually bothered to test drive it the first time, I would not have had to make a second trip down there after your guys had to do another, second complete tear-down to correct what was admittedly your firm's mistake.

a. Please elaborate on what your initial check sheet shows in reference to damage on the rear of the van, in precise terms.

In reference to: "We would also reimburse you for a $13.99 car wash at Danny's Family carwash, please submit the receipt to the Scottsdale Location".

a. Why do I have to use Danny's Family Carwash I live 30 miles away
b. The interior is also splattered with dirty rain because your guys left the windows rolled down on the day I picked up the van, and it rained heavily in Scottsdale that same afternoon. Why should I be foxholed into 13.99 when I don't know how much it will cost, interior and exterior when it was your guys that caused the damage to my equipment after I paid you for top notch service as your website claims.

Frank, put yourself in my place if thats possible remember I'm just a little guy and you are rich and powerful.

Lets Open This Thing Up

After speaking with several knowledgable parties we are going to have a certified mechanic remove the transmission and disassemble it to fully inspect the parts inside and videotape the process with several witnesses. Trying to get warranty service would be futile anyway, as we fear there will be additional damage to the vehicle while on their premises.

Here is my complaint as posted to a prominent state agency:

I felt compelled to use this company in response to claims they make on their website phoenixhardparts.com as follows, which I feel is deceptive advertising: 1. Each transmission is Dyno tested for quality 2. Our Production Department is staffed by certified technicians whose experience, and dedication to quality make us a market leader in Quality and Customer Satisfaction. 3. testers our tech department checks every unit for function and quality The reason I feel this is deceptive is that it took over a month to install a properly working transmission in my vehicle causing extreme hardship due to downtime.

When I dropped off the van for service, completion was promised within the week. However, there were numerous delays past that point always with the excuse that the transmission they had installed was defective and they would have to pull it out, disassemble, and re-install it. How can that be an acceptable excuse in relationship to their advertising points 1,2, and 3 listed above.

When I finally picked up the vehicle on or about September 12, the van did not shift right, experienced extreme vibration in the drivetrain followed by a burning smell. I returned the van to the shop and received phone calls back from the shop manager saying that the incorrect valve body had been installed and they would have to take the transmission back out and send it back to their repair facility for another teardown. Next phone call stated that the refurbished transmission had the wrong valve body, and they would have to track down the original transmission originally removed from the van, take the old valve body off, and re-install the old valve body back on the refurbished transmission before putting it back in the van meaning that I would be getting less than a fully rebuilt transmission. How could this mistake have been made, in reference to the advertising claims 1,2,3 listed above?

After another week I received another phone call stating that there would be an additional delay because when they test drove it, the transmission experienced catastrophic failure blowing up the torque converter and depositing a large quantity of metal shavings inside the unit. How could this happen, in reference to the advertising claims 1,2,3 listed above?

When I picked up the van for the last time on October 5, the vibration problem remains in the drivetrain and the van had suffered significant body and interior damage while on their premises. When I asked for compensation for the body damage, I was told that damage already existed when the van was dropped off for service, which is an outright lie.

When I contacted the Company Headquuarters about the body damage, a representative of Phoenix Hard Parts sent me an email message inferring that I must be attempting to defraud them, adding insult to injury. They asked me to get an estimate for body damage repairs but made no firm commitment to help pay for the damage, and essentially accused me of potential fraud.

In summary, my primary issue here is deceptive advertising on the company website phoenixhardparts.com, where I as a consumer was falsely led to believe that I would be getting a top notch product from highly skilled technicians who are leaders in the industry. After my actual experience with them, however, I don't possibly see how these advertising claims can be true. I would like the company's advertising claims to be investigated and if proven to be false or misleading, that they be levied a stiff fine and/or their business operations suspended or revoked in the State of Arizona.

My intent is to prevent other good, hard-working people such as myself from being deceived and lured into doing business with them by their misleading ads on phoenixhardparts.com and also on ebay where they also have a presense.

I would like others with similar problems with this firm to explore a class action lawsuit against this firm. Any attorneys out there who are interested please help us out.
