June, 28 2010                        Incident at work with Kerry

I was scheduled to work at 4:30 pm.  I went in at 4:00pm. To do my prep and side work.  I was back at the prep table next to the freezer. When another driver Chris who is a new driver came to me and asked me to show him how to do his prep. I was showing him how when Kerry came up to Chris and told him he had to put his hair up. Chris then told Kerry he wasnt on the clock so he didnt think it was necessary . Kerry told him if he was in the store his hair had to be up. Chris said my bad Kerry then told Chris there aint no my bad go put it up now and pointed at the door.  So I told Kerry he wasnt the manager and he shouldnt talk to Chris that way.   Kerry then went to Heather and was telling her the situation. So I went and told my side of it.  Kerry kept going on and on about Chriss hair not being up.   I asked Chris to please put his hair up and hat on to stop the conflict. He said no problem.  Kerry started fussing at me so I told him to shut the f--- up.  And went back to work.

After that I assumed that was the end of it. Not 15 minutes later, I was folding boxes and showing Chris how to print his MRDS for his prep. Kerry came out of the kitchen and got up in my face and said dont ever cuss me, now Im gonna get in trouble you f---n b***h. I got upset and told him to get out of my face and turned towards him and he ran off.  Heather took Kerry outside to talk to him and he told her he was apologizing to me.  She then took me outside and said she was suppose to send us home but if we agreed to stay away from each other she wouldnt.   I said no problem I dont go back in the kitchen except to the cut table.  Kerry told her he would stay away from me.

At 8: oopm. I was cleaning up to get ready to get off at 8:30. I was in the back washing dishes. I heard Kerry yell I got to go get my rings because she wont bring them.  He came back to the dish area and got his rings and starts throwing pans everywhere. One of the rings flew to the computer where we take orders.  I asked him what the hell his problem was.   And to pick them up.  Well it escalated.   And Heather told us both to leave.  We both clocked out and he went out the door from the kitchen to the lobby, stopping to make gestures. Then when I tried to go through the door. He slammed it on me hitting my cheek and pinning my arm and throat. He was holding the door on me. So with my arm that was pinned I was trying to hit him to get him off me.  Heather hollered for Peanut to come up front to stop us fighting.

Heather told me to stay inside and everyone went out with Kerry.     She came back and said we couldnt work the same shift. Thats kind of difficult since we both work every night so we both lost shifts.

  That night my throat and ear were hurting really bad the next morning I went o see the certified nurse at school and he said it was from trauma. Its bruised in side.  My arm also right below the elbow. 

  Now I know I shouldnt have let him get to me but, this is not the first time. This has been building and building over time.  But I shouldnt have to put up with this at work. Nor lose my shifts.  I was fired last night and he got to keep his job
