unscrupulous business practices of trying to keep deposits to hold product and unwilling to refund when consumer does to want to make purchase.
Place a deposit on a in stock camper Saturday September 5 2015 to hold for a week to then sign paperwork to take ownership. The day after Labor day on Tues I called to say I was not moving forward, the finance manager said let me see what I can do and I will give you a call back. He did call back with no resolve, He gave me a couple things to consider and I told him I will call him back the next day with a final decision. I did call back and after speaking a while the conversation got heated, he said they still expect me in on Saturday to take delivery.

I said you dont get it, I do not want the camper period. The next call was from our salesman carroll, he understood and wanted to help, I told him I think there has been to much damage to by the finance person chris. He also said because they dont normally ship out the RV with the final documents signed the same day, so they developed their paper work so people will (feel) they have to go through with the deal (during the days of waiting to take final delivery) I also told carroll if there was something on the paperwork im singing that I should be aware of, he should of pointed that out, he agreed, Carroll was nice enough to call me back to save the deal with a lower price, I said thanks, but running a business that way is not for me. He said if I dont want it , just fax over a note saying so, I did that. Now trying to keep my deposit because they feel they can, who does this?!?

    After speaking with a former employee, this has happened several times before. I am in a similar business and yes we dont like it when people change their mind, but they do and we hand them the deposit back and say maybe we can do business next time because that is the right thing to do especially if you care about your business and its reputation. I never would have stepped onto the lot if I knew they did business this way, absolutely shameful. 

This dealers actions may be lawful, but they are a disgrace to the NHADA and an embarrassment to the community. Shameful, absolutely shameful

The DOJ link you provided concerns new cars not campers. Is this a new or used camper? Is this camper an automobile? You were quick to quote the statement concerning the deposit but failed to quote, “You probably should not make any deposit if you… Think that you might change your mind for any reason”.

You did not respond to my 11/15 request for you to provide a link to a New Hampshire Automobile Dealers Association webpage that supports your claim that they consider nonrefundable deposits to be a disgrace. You did not respond to my request to provide a link to a NHADA webpage that implies they frown upon that policy.

You have posted statements and policies concerning the NHADA. You wrote, “…Incident also on file with NHADA AutoCap”. The NHADA Auto-CAP website that you provided states, “AutoCAP does not become involved with dealers who are not members of the Association”. Are you sure that Rte. 125 RV & Marine is a member of the New Hampshire Automobile Dealers Association?

You did not respond to my 11/16 statement, “If you are stating that the refund policy on your copy of the Amex receipt differs from the merchant’s copy then you have a valid complaint.”

1)Its not a link directly about deposits, It about thier "good will" practices, and obviously returning money for no services or product provided would fall under that, Keeping money is not being dealt with fairly

Good Will Is Good Business

Members of the New Hampshire Automobile Dealers Association pride themselves on the good will and reputation they have built with their customers and consider it a sound and essential business practice. Good will is established with a customer when they are satisfied with the product and service they have received and believe that they have been dealt with fairly.

If you are experiencing a problem and are dissatisfied with your new or used vehicle, give your dealer a chance to show his/her good will. Whether the complaint is about a defect, repair, warranty, or some other item, there is probably a reasonable solution.

Your deposit should not be more than $100, unless the dealer is making special preparations or installing special equipment. The deposit is intended to cover the dealer's cost of preparing the car for you in the event that you break the deal. The deposit should be reasonably related to the cost connected with the process, such as typing up loan forms, odometer disclosure statements and similar paperwork.

 

3)The ridiculous deposit being refunded, maybe I was not clear. I should have added that " I was going to have it refunded after because I was going to finance the total amount"

 

4) Amex, The most recent phone conversation with Amex. They do not care that sales slip says " non refundable payment and ruled in my favor, And they still have not shown them anything thats satisfies them (Amex)

Unscrupulous meaning:

Having or showing no regard for what is right or honorable; devoid of scruples.

 

Unethical meaning:

 not conforming to approved standards of social or professional behavior; "unethicalbusiness practices"

I dont know why I fell for the 10 percent down to hold scheme, NH Attorney Generals web site states deposit should not be more than $100 for a in stock unit. Not pointed out at the time of sale that refunds are not available, and furthermore I told our sales man even though your asking for a ridiculous deposit, I guess it doesnt matter because im going to have you refund me the whole amount after. 

Furthermore, Days after when it all fell apart and I said you should have told me what kind of dealer this is, my salesman  admitted he should of told me what I was getting into. Again I placed trust in the wrong party.

Buyers remorse? no. Sellers remorse yes, becuase you have to swallow the bitter pill when someone changes thier mind

If you gave a great buying experience, including best price and a solid reputation, you would not need the "trap into sale with a high deposit scheme"

Amex already rules deception because you slid that additional line on the credit card slip stating non refundable deposit, and after you sent them only the copy of that (making them think I had product, they quickly ruled in my favor

 

Let me finish with this to bring complete clarity. You can not justify keeping customer huge deposits you ask for just for putting a sold tag on these in stock units for a day or a few days, you really think thats smart business? Every dealer I know (as I am in the business) does not do this, Mainly because they care about thier business and hopes maybe the can sell them something next time.

 

Hopefully more victims will come forward.

The link you provided does not address NHADA’s opinion or policy regarding deposits. You failed to provide the requested information. It appears you fabricated the claim, “This dealers actions may be lawful, but they are a disgrace to the NHADA…”

Please provide a link to the attorney general’s webpage that states the maximum deposit a merchant can require. This time actually provide a valid link that substantiates your claim.

That implies you never intended to purchase the item. You appear to be somewhat loony.

If you are stating that the refund policy on your copy of the Amex receipt differs from the merchant’s copy then you have a valid complaint. If that’s the case you should have mentioned it in your initial report because it is vital to your case.

You forfeited your deposit

Nothing in your report supports your claim of, “unscrupulous and unethical business practices”.

You gave the seller a deposit to hold the camper. That obligated them to take it off the market and possibly miss out on a sale from another customer. You reneged on the agreement so you should expect to forfeit your deposit unless your deposit receipt or bill of sale specifically states the deposit is refundable.

Please provide a link to a New Hampshire Automobile Dealers Association webpage that supports your claim that they consider nonrefundable deposits to be a disgrace. At least provide a link to a NHADA webpage that implies they frown upon that policy.

You either changed your mind or you are suffering from a case of buyer’s remorse; therefore, it is unlikely that Amex will rule in your favor. Amex will rule in your favor if you are the victim of fraud or deception. That does not appear to be the case.
