I was diagnosed with cancer and going through treatments.  My husband also has prostate cancer and neither of us were working.  We had the car voluntarily repossed 2 years ago (July 2016). 

This company sold the car and recovered all that we owed except $2,000 (or at least that is what they told us), but Safco is still reporting as if we still own and have a balance of $8,000 and that we are late making the payment every month. 

I have disputed this so many times, but because Safco pays the bureaus they will not correct the problem.  This is so unfair and straight out fraudulent.

Hopefully you are doing better health wise, but with that it is always quite humerous when someone deflects from the actual issue trying to bring in various things to make their story sound more sympathetic or that are not really part of the issue.

You were delinquent, sadly the reason does not matter, the car was reposessed(voluntary or not does not matter), you have a deficency balance that was owed and apparently failed to have paid off.

As for your report, EXACTLY what are you disputing? It just seems as if you are disputing a negative item by wanting a different negative item reported instead. The net isn't really any benefit to you because they are both severe negative items. While you have the right to dispute it having a delinquent account for $2,000 or $8,000 doesn't really make much difference in terms of your credit score or creditors willingness to loan you money. 

The only way this would really end up in a positive for you is if you have proof that you paid off the deficency balance, thus making the entire collection invalid. In that case you can use Federal Regulations such as the Fair Credit Reporting Act(FCRA) and/or the Fair Debt Collection Practices Act(FDCPA) in your favor. The fact that they pay the Credit Agencies are not the reason these items are still on your report.

Now, if you have failed to pay the deficency balance then all of the reporting is likely valid. Because the deficency balance is owed at the time you incurred it(when the car was sold at auction), every month after that it may be able to be reported as late.  Do you have anything in writing that states the final deficency balance is $2,000? As if you do, you may have a good case to have the amount adjusted. But again the lower amount may make you feel better, but it won't really change anything. You also have to account for the additional interest in the last two years. So even if you did owe $2,000 a couple of years ago, it may be more now.

I would suggest you get all of your paperwork together and consult an attorney. You may be able to find one to give you a free short consultation. But even if not, paying for an hour or two might provide you great insight to get this cleared up if you are indeed right. Or if you are incorrect to give you suggestions on how to proceed.

 The car was a repo and you owe a deficency. You have also run up extra interest charges, late fees, possible repo fees etc. If this hasn't been paid, then yes, you may owe more that $2000.

If you haven't made payments then you are late. No, I don't work for them.
