greetings,i was 2 months behind in our mortgage,in february 2006,it was 3 months,i sent a bank check for the 3 months over the internet as i have done many times before,1 week later it had not been cashed,so i called sps,and they said it was now in foreclosure,they offered me a forebearance agreement,2800.00 down,704.00 a month for 6 months,on september 30 when the agreement was to end, a balloon payment of 9211.36 was to be received,if not foreclosure would continue.it took these professionals almost 5 weeks to approve the forebearance plan,of course we had to retain an attorney.my wife was home when she was hand delivered foreclosure documents on 2 separate occasions.you see, reputable financial institutions would have offered the agreement first,then if that did not work out,they would have no recourse but to start forclosure proceedings,but this is the way sps/fairbanks makes extra money,and makes it very difficult to refinance.when you mention sps/fairbanks to a potential lender,they actually feel sorry for you.i asked for a payoff to be sent to me,no problem,first they charged me 20.00 for the payoff,not once but twice,in new york they can not charge you for a payoff,i got the first payoff on 5/15/2006,the expiration was 5/13/2006,great people huh?after 5 months of trying to refinance(i must have tried at least 30 lenders)i found a company that would refinance us.we closed on 10/05/2006,and we just received a letter of congratulations from sps yesterday 10/28/2006,stating,congratulations we have received the full amount due to payoff your loan with sps,this payoff is effective 10/17/2006.i plan on framing this letter to remind me of how close we were to losing something so important to us.please don't get me wrong i was the one that fell behind in the payments,but sps/fairbanks started proceedings first,then offered the forebearance agreement,all the lenders i talked to said the same thing sps/fairbanks are crooks and should be shut down for the way they treat their clients.finally for all of you that are dealing with these crooks,persevere and you will find some company that will help you,i did,at a lower rate!!!!!!!!!! WHAT A RELIEF TO BE RID OF THESE BOTTOM FEEDERS

On may 7th 2007,we just refinanced our mortgage,from an adjustable rate of over 12% to a fha fixed 30 year rate of 6.25% with a reputable bank.As much as fairbanks/select portfolio servicing tried to make our lives miserable(they did for a while),we refinanced in the fall of 2006 to get away from them to a place called fremont investment and loan,which on may 1st sold the loan to emc mortgage,1 week after the sale to emc we closed on the refinance at our new rate of 6.25% fixed fha.We got out of a very bad situation,by making sure our payments were timely.please note that forebearance agreements should be handled by your attorney,it will cost extra to get your lawyer involved but it is well worth the expense.We are so glad to be rid of sps,and i hope that anyone that has to deal with these low-lifes will come out on top.Finally I hope select portfolio servicing will be drowning in lawsuits for many years to come,with any luck they will go under,HARD.Good Luck

I am in the middle of refinancing now. What SPS/Fairbanks did when they found out we were going to refi was slam my credit report so I wouldn't qualify. Listed a bunch of lates that weren't late. Nice huh? Anything to make a buck.

Fortunately, I had already done what was suggested by others and sent everything with signature required and kept those copies.
The credit bureau is doing the credit repair now. FTC is opening another case file.
We are also going back to my original loan documents to confirm that our rates are correct. Penn fund owned my note. Then citibank, then fairbanks and now sps. My rates never went up (beyond teh 1% loan increase allowed) until sps took over. Even fairbanks didnt raise it over the allowed limits. Funny how my payments went up $150 since they got my note.

And I dont even want to get started on the insurance scam!

I read all of these now that I am out of that miserable place. The employees are not treated much better than the customers.

You definately should collect as many facts as you can regarding any possible violations of the FTC agreement made with Fairbanks/SPS.

You know its the exact same company.

I worked for this company for a long time. I have a lot of insights to the processes of the Loss Mitigation/Loan Resolution department.

Do you know it should not take 5 weeks to get a forbearance agreement? It should take no longer than 7-10 days.

I am looking for other victims, such as yourself, to speak to regarding their actions. PLEASE get in touch with me ASAP. I am on a fact finding mission for a firm regarding potential "Best Practices" violations as they pertain to their USA v. Fairbanks agreement. A search of the web will also pull up my contact info.
