On my visit to their model home in Heights in Oct 2014 I was proposed by Squarestone Homes to build a home.Based on their initial proposal of $200000 investment 20% of the project of one million they assigned me a sale contract of the house which they already had under contract with $5000 earnest money and hooked me up with Proffered Bank for financing.On application for financing, bank warned about the time constraint for closing property on time and advised us extension of the contract which Squarestone Homes failed to get it approved and I end up Paying $460,000 out of my pocket to close the property.

After acquiring the land the first step was to get the Architectural done, they advised me to go with his Architect as they offer better price and they can get the complete job done for me for $7000 fee ,I decided to do so,now after I got through the demolition of the old house and other necessary things done with additional $20000 of expense they ask me to sign a construction contract with them and pay them $54000 in advance in order for them to start construction which was never discussed or disclosed by them plus the contract is completely unbalanced and builder friendly with no owners rights which is unacceptable and on the other end on their advice I requested bank to extend the initial approved loan of $540000 to $600000 so I can pay them $54000 to begin construction but bank declined the request and denied the loan due to the fact that its against their policy to pay any one before the work is completed.

Because of Squarestone Homes deceptive trade practice that they knew to begin with about Bank"s payment schedule for construction loans and they failed to disclose that they require 10% advance payment to begin work I decided not to construct with them therefore I asked them to release the Architectural plans or refund the amount they have collected from me against the plans but they refused to release the plans or refund me the amount, which is totally unfair and deceptive trade practice.

I would like to bring this to public attention that please read Squarestone home's owners above statement that he has a investment program for investors and he assigns contract to investor, after making investos to invest money on assigned contract he says that he is out of the picture so he will come back in when its time to sign the contract when its time for him to collect the money from investor, so during the whole process of building the house in his investment programe he has no moral or legal obligation to disclose the facts to protect investors and help them  make informed decission,read the contact and please take it to attorney before signing it because after you sign it in good faith, he will put you in the picture and he likes to stay out of the picture.As he feels no obligation to disclose and discuss his contract in the bigning,he brings it out at the end and if you have any issue with the contract or decide not to sign it the prices he quotes in the bigning means nothing, it can change on his discretion, he feels he has no obligation to owner his own quoted prices in his intial investment proposal as he dosen't disclose this facts about his trade practice upfront.Same thing happened with me his initial quote for architectual plans was $7000 in his proposal and now he is holding the plans hostage to get more money for it. I asked him to refund the amount of $6500 he has collected from me aginst the plans or release the plans, I am ready to pay the Final invoice issued by his office for plans and he dosen't want to owner his own issued final invoice, he refused both option where as holding plans hostage demanding more money which is totally un ethical and unfair. I leave upto the public to decide who is right and who is wrong.

Iqbal Kazani approached us to participate in an investment program that we offer with real estate development. We found a lot inside the loop in Houston and passed it on to him. Typically we charge a fee for our services in finding the lot but he kept pleading with us to remove the fee since he would be building with us and because it is his first project. We obliged. He then negotiated our construction cost down even though we did not have much of a markup in there anyway. After we connected him with our banking partner to secure financing, he kept shopping around till the last minute for better terms and as a result was not able to secure financing on time. He then blamed us because the seller would not grant an extension on the closing date. The fact is that once the contract is assigned to him, we are out of the picture and have no say in altering the terms of the contract and getting the seller to extend the closing date. Even a novice in real estate knows this yet this person has listed this as a accusation in his report.

 

We then negotiated a heavily discounted rate with our architect since he would be building with us to help draw up the plans for the proposed project. There was a lot of work done from our side in getting the project to this point and we had not received any compensation and we were doing it only based on the good faith verbal agreement that we would be doing the construction on the project. After everything was done and we had permits in hand, he told us he does not want to the pay the upfront 10% that is due at project kick-off for ordering materials etc. for the project. Again, it is common knowledge that any fixed fee build contract requires a percentage upfront because the builder is not going to risk paying for materials for the project out of pocket and risk having the client default. Again this was common knowledge that this person was not aware of and kept saying we deceived him by not telling him this earlier. We offerd to work him on a cost plus basis and he refused. We said since he does not want to pay us the money upfront, he can pay the vendors directly for materails and he refused that as well. He lied saying that he does not have the funds to start the project. We then found out that it was not a funds issue but he did not want to proceed with us anyway because now he had complaints about the fixed fee contract being too builder friendly. This is just a regular GHBA fixed fee contract and was not something we made up on our own but again, this person had issues with that as well. We were ready to move on after deciding it was not worth the hassle and asked him to pay us the discount that we negotiated with the architect for the plans since he was not going to use us anyway and he did not want to pay that either. He basically said give me the plans or I am going to take legal action. He then proceeded to harass us by posting reviews with a lot of false statements online. We have more than a dozen investor clients we cater to that have done multiple projects with us and we have never experienced anything even remotely close to this with any of them. Unfortunately we made a bad judgment by deciding to do business with this person and more importantly proceding to do work on his behalf without anything in writing and what we got in return was just a huge headache.
