I was the seller of two football tickets on Stubhub to the Champs Sports Bowl game which occurred on 12/29/2011 in Orlando, FL.  On or before 12/12 my two tickets were purchased on Stubhub by an unknown seller.  The seller had a question about my two tickets as they were located in Section 302, Rox C seats 1 and 3.  (Seat 2 was empty and I had every other ticket in row B and C.  Two people backed out of my block, so I sold those two tickets including an aisle seat).    I listed everything as accurately as possible about my two tickets given the options the Stubhub website let me.   The buyer purchased the tickets for $150, so I was paid $134. 30 after Stubhub took their $15.70 commission from the seller (buyer pays commissiont too on same tickets).

I uploaded my tickets to Stubhub as a .pdf as Stubhub requested.  When the buyer received the tickets, the buyer contacted stubhub and understandably had a question about Seats 1 and 3.  Stubhub contacted me and I explained to them we had the entire block of seats and that they would be together.  on 12/12 Stubhub put me on hold and called the buyer and agreed to accept the tickets.   I attended the game on 12/29 without hearing from Stubhub again.

However, I received an email from stubhub on the morning of 12/30 indicated my transaction had been cancelled by the buyer and Stubhub "wished me luck" selling my tickets to a game that occured THE NIGHT BEFORE.  I immediately began an email coorespondece with Stubhub to document the dispute in writing.   Their responses to me were very heavy handed as if I (the seller) did somethign wrong and they treated me like I was some internet scam artist.   I work in law enforcement and have experience investigating internet fraud and ive sold hundreds of items on Ebay and Stubhub combined.  After explaining everything repeatedly to stubhub their answer was something to the effect of  "you should have read our terms of service", and they indicated they no longer wanted to discuss the matter.  

I continued my written coorespondance and even uploaded a photo of our block at the football game and pointed out there were two individuals sitting in seats 1 and 3, the very tickets that I sold.   I informed Stubhub they were likely scammed by a buyer who took my tickets, and either used them or sold them and made a profit on the $150 tickets he received from me for free.  Stubhub refused to acknowledge my photographic proof as well as Stubhubs guidance to me on 12/12 that my transaction was approved and I was paid.  Also, Stubhub never acknowledged the fact that they notified me of THEIR cancellation the day AFTER the game.

****  My Question is, if my transaction was invalid, then why did Stubub send me the money for the tickets I sold?   WHY did Stubhub send them my .pdf tickets if the sale was not valid?  The transaction is either valid, or it is not.  Why did they send me the money only to take it back weeks later after the buyer had buyer's remorse, or even scammed Stubhub?    I believe the buyer had an invalid credit card number and once Stubhub realized it, they stuck me with THEIR financial loss.  Or perhaps the buyer knew of the buyer's loophole in most Stubhub transactions and knew they could scam Stubhub out of the money.  Now Stubhub is scamming me.  

My only other option is to take them to Small Claims court.  Based on Stubhub's actions to help facitilate the sale (paid me, sent buyer the tickets), I believe they dont have a leg to stand on to cliam the transaction was invalid or against their terms of service when THEY are the ones who facilitated the sale.  

I do not believe Stubhub became as successful as they are by treating customers this way.   And I am still shocked they refuse to do the right thing here.

ive continued my discussions with Stubhub and they refused to do the right thing. these are thenfacts:

1. I sold two tickets to the Champs Sports Bowl for $150 on 12/9/11

2. Stubhub kept a $15 commision for the sale on 12/9

3. Stubhub and the seller knew they were seats 1 and 3 and provided my .pdf tickets to the buyer anyway. On 12/12, I had a phone call with Stub and they had buyer on the other line who agreed to take seats 1 and 3. That superceeds their agreement as the buyer, seller and stubhub all agreed to complete this transaction

4. Had Stubhub insisted on 12/12 that i had to provide consecutive seats, i would have and we wouldnt even be having this conversation. (i had all seven seats in the first row and 5 of the 7 seats in the second row. Each row has 7 seats, and i bought seats 1 ans 7 to ensure i had an aisle seat and also had seats 1, 3, 4, 5, and 7. 2 and 6 were never sold . i guarenteed the buyer would sit together and everyone agreed

5. Everything was fine and the game started at 5:30pm on 12/29 EST

6. I received an email from Stubhub dated 12/29 at 8:30pm EST that the buyer changed their mind and that Stub cancelled the sale.... note the THREE HOURS after the game started. The email header time stamp was 12/30/11 at 1:38am , +5 hours from Eastern

Bottom line is Stub kept my $15 and my $135 for $150 total and my tickets were worthless after being told the sale was done and then they pulled the rug out from under me. and the. to add insult to injury , they tell me AFTER the game starts so i have NO chance to resell them.

Never deviate from site policy unless you're willing to take the risk it might be used against you, as it evidently was this time.

You might have a case against them if you have all documentation that the seat positions were clear, and that the time that elapsed between the sale and the game without any objection from them or the buyer served as reasonable proof the transaction was acceptable to them.

BUT you'd be burning your bridges with them in doing so.

Obviously, if you plan to continue your business there, you need to eat this loss and allow the matter and the rancor to die.

In of off chance you are able to prove any connection between the folks in those 2 seats and the buyer then I'd think you could go after him.

What happend at the game?

You say that you had every seat in two rows, with the exception of seat 2.  First of all you have to admit that this is a very odd seat to NOT have.  So did you have seat 2 as well?  If so when you were selling seat 1 and 3 why didn't you sell seat 2?  If you didn't have seat 2 how could you 100% guarantee that it was going to be empty?

Then if you tell StubHub that they would be together, that infers that when they arrive at the game YOU would change the seats around so that they would be next to each other.  I bring this up because that would involve you actually talking to the people in those seats during the game.  Yet all you have is a picture of two people in that seat, and gave no indication that you even talked to them.

So answer this.  What proof does StubHub have that those people in the seat were not part of your group?

Also, the above poster was correct which makes any other claim that they Ripped you off a mute point.  In their terms as part of the sellers responsibility there is the following

(ii) Piggyback seats.
With the exception of "piggyback" seats (seats that are directly behind one another, are in two consecutive rows, and have the same number of seats in each row), you agree and understand that if you are listing more than one ticket for sale, the seats for the tickets you are listing must be
together (together means consecutive and adjacent)
. If you are listing "piggyback" seats then you are required to check the box designating the seats as "piggyback" when you list them.

self service

Ive used Stubhub and it's pretty simple, their user agreement shows that they are a self service website and when you list tickets it tells you to list seats that are together. I wouldnt want to go to a game and have a stranger between me and the person I'm there with.
